Kwoka's take, like that of so many others, begins with the assumption that the president is an employee of the federal government. Constitutionally, that is not the case. The administrative agencies, at least the ones in the Executive branch, work for the president, not the other way 'round. That being the case, the President MUST have ultimate authority over which documents he retains at the end of his time in office. He can't go back and get more stuff after he leaves office but if he has it when he walks out the door it should be his. After his time in office the issue would only be with regard to what he does with the documents.

Got it, your posit is the Prez is above laws passed by Congress!

The Presidential Records Act (PRA) defines what constitutes “Presidential records” and what are “personal records.” 44 U.S.C. 2201. Personal records include “diaries, journals, or other personal notes serving as the functional equivalent of a diary or journal which are not prepared or utilized for, or circulated or communicated in the course of, transacting Government business.”

The PRA also requires that all documentary materials “be categorized as Presidential records or personal records upon their creation or receipt and be filed separately.” 44 U.S.C. 2203(b). The President does not have discretion to categorize a Presidential record as a personal record

Did Presidents before Nixon have total control over their records?

Prior to the Presidential Records Act of 1978, which first applied to President Reagan, all of the official records of the White House were considered the personal property of the President (from Presidents Washington to Carter). Presidents Hoover through Carter chose to donate their records to NARA, along with the Presidential Library buildings where they are stored.

While these Presidents had control over their personal papers, they lacked control over the classification status of any records that were classified. The classification status of the information in the papers remained under the control of the U.S. Government.

The Nixon records, including the Watergate tapes, were seized and transferred to NARA in 1974 by a federal law, known as the Presidential Recordings and Materials Preservation Act (PRMPA), 44 U.S.C. 2111, note. In response to the Nixon issue, Congress enacted the Presidential Records Act in 1978 to change legal ownership of Presidential records from the President to the United States Government, which took effect at the beginning of the Reagan administration.

So you once again said something that Trump said that wasn't what he said. Now your saying I'm claiming something, no it's what the whistleblower that's been on the fbi payroll for over 10years is saying. You know just like the guy that was listening on the phone with Trump and Ukraine President and the left lost their mind to hear the tape. What's good for the goose is good for the gander....

And all that is a civil matter with no criminal aspect as the supreme court confirmed in the Clinton Socks case. Now all that being said, this isn't about records, it's stated that Trump had boxes moved to hide them from investigators instead simply fighting the subpoena so it's more about obstruction. They went to espionage that's used rarely in spy cases and is what's going to ruin this for the prosecution. They went for the kill shot and want the guy to die in jail, ok now if it fails this lefty all but guaranteed Trump gets reelected.

BZZ, TRY to keep up, that case had to do with PRIVATE documents (tapes from a historian) of the DIARY type. SCOTUS never looked at it.

This case is about Diaper Donnie's WILLFUL disregard for the return of GOV'T DOCUMENTS, SOME OF WHICH WERE CLASSIFIED, SOME NOT, but all are US Gov't property

How Trump’s Classified Documents Case Differs From Those Of Clinton, Biden And Pence

    The Trump Case

A federal grand jury has indicted Trump on allegations he willfully retained national defense information under the Espionage Act, making false statements, conspiracy and obstruction.

The former president has been under investigation for more than a year for taking classified documents after he left office and not returning them after requests.

Here is a noble idea, win election, became POTUS , appoint AG and investigate.

Oh , Trump did win in 2016 and appointed 4 different AG and investigated but couldn’t find anything. Trump handpicked FBI director couldn’t find anything against Biden or Hilary. Trump still wanted to find “dirt” on Biden so he went outside USA and called volodymyr Zelensky to investigate Biden. But still didn’t get anything. Oh , my mistake , trump did get one thing – “ A big bipartisan impeachment” .

    Disgraceful.

In their role as oversight of the FBI YES that is the issue they are not a criminal investigative agency. That is why they are calling for a special prosecutor.

Biden is corrupt - you want to be in denial about it; yet think you are any different than the people who believe all of Trump's BS

Just because your MSM ignores it while they obsess over Trump. does not make it any less true

All that money funneled to various Biden family accounts - yep nothing to see there

and by the way the 2nd impeachment was "bi-partisan", not the first

    What FBI report?

We already have some of the bank records and more are coming thanks to Grassley and Comer. What is the basis for your simple dismissal of the whistleblower allegations?

Kushcher runs an investment firm and MANAGES $2B of other peoples money, it was not $2B that was given to him it is in accounts of those persons who invested and I under are enjoying his very good management of their investment. The Biden family ended up with TENS OF MILLIONS in their personal bank accounts that had originated from our worse foreign adversaries through and huge laundry of LLC's. What product or service did the Biden family provide them for those $10's of millions.

Trump had 4 Hand picked AG of USA and hand-picked FBI director. 4 years they tried and found Nothing against Biden. Rudy Giuliani went all the way to Ukraine to find Biden's corruption and only thing he bought back for Trump was an “ Impeachment”.

But I believe when you say “ Biden is corrupt” just hold your breath , I will believe.

LOL tapes of a historian. Good grief hook line and sinker but a question was those his tapes or the governments? see how this work. That being said, as I have said repeatedly this isn't about the documents, it's about defying a subpoena instead of fighting it. Supposedly Trump had some moved, if that's true it's obstruction, certainly will have a hard time proving espionage and the dumb left will get the idiot elected again. Congrats.

Cherry picking as you have been called out on before. You can't quote him saying "create some new votes for me" so you cherry pick and refuse to post his entire statement.

What kind of votes did he want found and what did he want done with them?

Bet you won't answer that so get back on the topic at hand.

Yes one of their most trusted undercover informants. And that is just ONE little sliver of all the evidence and mountains of bank records and they are not even half way through all the banks yet.

I realize FACTS are hard for right wingers, but yes the Clinton "socks" case was about recorded conversations (later used for a book) that Clinton kept in his sock drawer, clearly PERSONAL Documents VS Gov't docs, like a journal or diary

Sure Diaper Donnie will get relected, lol

Cool, almost 5 years when is the GOP going to release the info on the Bidens?

Republicans Acknowledge Biden Bribe Audio Might Not Exist

The alleged Joe Biden bribe was allegedly caught on tape — but nobody can say if either allegation is true

Speaking about the recordings on Newsmax Tuesday, House Oversight Committee Chair James Comer (R-Ky.) said lawmakers “don’t know if they’re legit or not, but we know that the foreign national claims he has them.”

“We don’t know for sure if these tapes exist,” Rep. Jim Jordan (R-Ohio) said on “The Chris Salcedo Show” Wednesday when asked if Republicans would consider impeaching the president.

Sen. Ron Johnson (R-Wis.) suggested on a program called “The Conservative Circus” that not only might the tapes not exist, but also that the foreign national who spoke to the FBI informant might lack credibility. (Some Republicans on the Oversight Committee have said the source is former Burisma executive Mykola Zlochevksy, a fugitive Ukrainian oligarch.)

We don’t know really if the tapes exist, we just don’t know that, whether this was just a bluff on the part of, whoever the executive was, I think it was Mykola Zlochevsky, the CEO of the... the corrupt oligarch,” Johnson said.

    Enter Donald Trump.
He over played his hand and got played. Which is a sign he really wasn't ready for the big stage as he thought. Real change cimes from the center, Republicabs could learn from that.

    YOU STATED THIS

"It was happening and Biden wanted it stopped for a reason. What was that reason? Why did he and his son get $10 million that was laundered in order to hide the payments?"

Before Giving Billions to Jared Kushner, Saudi Investment Fund Had Big Doubts

Before committing $2 billion to Mr. Kushner’s fledgling firm, officials at a fund led by the Saudi crown prince questioned taking such a big risk.

Six months after leaving the White House, Jared Kushner secured a $2 billion investment from a fund led by the Saudi crown prince, a close ally during the Trump administration, despite objections from the fund’s advisers about the merits of the deal.

    Those objections included: “the inexperience of the Affinity Fund management”;
the possibility that the kingdom would be responsible for “the bulk of the investment and risk”; due diligence on the fledgling firm’s operations that found them “unsatisfactory in all aspects; a proposed asset management fee that “seems excessive”; and “public relations risks” from Mr. Kushner’s prior role as a senior adviser to his father-in-law, former President Donald J. Trump, according to minutes of the panel’s meeting last June 30.

Kushner Firm Got Hundreds of Millions From 2 Persian Gulf Nations

The infusion of money from interests in the two Persian Gulf monarchies reflects the close ties to Middle Eastern countries established by Jared Kushner, former President Donald Trump’s son-in-law.

Wealth funds in the United Arab Emirates and Qatar have invested hundreds of millions of dollars with Jared Kushner’s private equity firm, according to people with knowledge of the transactions, joining Saudi Arabia in backing the venture launched by former President Donald J. Trump’s son-in-law as he left the White House.

The infusion of money from interests in the two rival Persian Gulf monarchies reflects the continued efforts by Mr. Trump and his aides and allies to profit from the close ties they built to the Arab world during his presidency and the desire of leaders in the region to remain on good terms with Mr. Kushner as his father-in-law seeks the presidency again.

Weird Diaper Donnie had 4 AG's in his 4 years, what did they do with that info?

What's their basis for this allegation?

A suspended FBI agent, who Republicans view as a whistleblower, told lawmakers on Capitol Hill in May about the form detailing the interview and has alleged the FBI tried to bury it.

Why didn't the FBI want to hand over the document?

It contains what the FBI calls "unverified" information.

Essentially, anything could lead to an FD-1023 form, which does nothing more than acknowledge an interview took place.

While Republicans are assuming there is a coverup, it does make some sense that if the FBI had gotten a wild claim that it could in no way substantiate, it would not want to give oxygen to that information.

After all, much of Republicans' gripe with the Russia investigation is that it stemmed from allegations about Trump that could not be verified. For more on that, read about the recently released report from special counsel John Durham, a Trump-administration appointee.

How long has the FBI had this document?

For years. In fact, it dates back to the Trump administration.

CNN's Evan Perez has reported that the document has origins in a tranche of documents that Giuliani provided to the Justice Department in the run-up to the 2020 presidential election.

WELL HELL THAT PROVES IT, IF AMERIKKKA'S Mayor says it's fact, it's got to be factual'

Weird Barr had it and did nothing with it?

Hunter Biden’s prosecutor rejected moves that would have revealed probe earlier

Veteran U.S. attorney David Weiss, known for his willingness to take on powerful Delaware figures, kept his investigation into Biden’s son out of the 2020 campaign.

...Since taking office, President Joe Biden has left Weiss — a Republican appointed by Donald Trump on the recommendation of Delaware’s two Democratic senators — in place. That puts him in one of the most sensitive positions in the Justice Department, deciding how to proceed with an investigation of the president’s son that has proven politically fraught on several fronts.

Hunter Biden has been under investigation since 2018 by the office of U.S. Attorney David Weiss of Delaware, a Trump appointee.
