    Trump could have called those that did and Trump had to give the authorization to the guard, Trump did more to get his bible photo op then he did to stop the Jan 6th terrorist attack

    the Capital is not run by the State, it's federal jurisdiction.....

    It has to be proven. That was my point. But, he incited the crime when he told them "when there is fraud the rules change." He doesn't have the power to declare whether or not fraud was committed. That's for the Court's to decide. He attacked both the Courts and the Congress, violating the doctrine of "separation of powers." And, he confessed to such violations in front of thousands of people, as well as millions in the tv audience.

    On the contrary, it's been the tool of the left since day one to try and destroy him. The allegations, insults, implications and fake charges started even before he was elected and never quit. The only people who pretend not to know this are those who embraced such thuggery for their own purpose, and have no moral respect for anyone but themselves. Never in our history has such a large percentage of any political group discarded it's self respect and moral values to enable them to act like trash. Unprecedented, un-American- and despicable.

    The question is not that some speech violates law- it's that some speech violates the constitutional amendment.
    The biggest and most consistent liars in this 5-year pissing match are without question the left. They started it, totally on a personal basis- and became so devoid of integrity and respect for the constitution that anything was justifiable. It's not hard to see- it's obvious, assuming you don't have your mind locked down to twist truth, and can actually look at things honestly.

    Now those who support that have gained power- and Biden, the puppet, is making GW Bush (AKA the Shrub) look like a genius. If Trump had done anything near what is going on now, the left would have exploded. Instead, they stand around and not while shooting themselves- and unfortunately all the rest of us- squarely in the foot, over and over. No need to take my word for it, just watch and wait. You're going to see one of Americas worst periods ever, because the left failed to act responsibly, and allowed petty hate to destroy their self-respect and self-control. I'd love to think I was wrong. However- not.

    Trump was despicable from 2015 onwards and completely unfit for office. His WH years were nothing but chaos and constant lies.

    There is nothing illegal, immoral, or even untoward under the circumstances -- let alone coming within light years of impeaching -- about that. The fact that Pence had no authority to follow Trump's suggestion and didn't is not relevant.

    Of course, you are correct. The authors of the constitution properly prioritized things; they knew freedom of speech must be unencumbered as a basic right, and consequences of what we chose to say dealt with on a secondary level if appropriate.

    It's amazing that the very best concepts are often the simplest in structure- and the more you complicate them, the more loopholes and confusion you create- and our congress not only keeps adding, but keeps changing laws and regulations. Nobody- Nobody- can ever learn all the rules and thus be able to consistently comply with all of them. That shouldn't be so, but it is.

    The Epoch Times is anything but trash. They might be biased but they report only real news. The NY Times is biased and that never bothered me. Hell's bells, everyone carries some biases. What bothers me about the NY Times (and others) is not their bias but their giving up journalism for political advocacy.

    Which is why the US economy set record after record and improved standards of living, employment and dozens of other things- and why the left turned away from arguments of such things because they had nothing to speak to.. So, they chose things like his suntan. And of course, the endless cascade of total fabrications like the dossier. But- you didn't notice those things, right?

    The task being asked for Mike Pence to carry out violates his constitutional duty. This task was being asked by the POTUS.
    And when Mike didn't do the unconstitutional act, trump held a rally to tell supporters to fight against this steal of the election.

    23 times in his speech on Jan 6, 2021. trump told his supporter to fight. Fighting is an incitement.

    How do you not know this??

    You probably aren't aware of it, but people can sue you because they don't like the color of your tie or the shape of your nose. There is nothing that says politicians or the DOJ or supporters of the left can't make total asses of themselves. Doesn't mean a thing- but they are free to do it.

    My understanding is that whole "domestic terrorism" is defined by the FBI, there are no specific laws against it. Domestic terrorism would be prosecuted under existing laws against such things as insurrection or sedition or the criminal code crimes (breaking and entering, attacking law enforcement people, theft, etc.).

    And, judges may throw out such suits as frivolous. My son just won such a suit.

    He incited no one to commit any crime or any violence. He most assuredly has the unmitigated right to claim fraud. Criticizing either congress or the court in no way violates the separation of powers. If you want to understand violating the separation of powers principle go look at the House's actions the past couple of years.

    Of course, as well they should. Problems however arise from frivolous suits for big corporations, who often make a settlement to avoid the cost of defense and negatives of publicity. That encourages such things, as well as rewarding immoral lawyers.

    I'd like to see a situation where judges could order the plaintiff to pay defending legal costs when a suit was frivolous or unreasonable.

    The prescient framers knew that every paragraph added to the constitution watered it down a little. They took great pains to keep it short and simple knowing that that would leave the door open for shenanigans which they had no possibility of closing

    You know, I read that single article of impeachment and no where is it written that ******* Trump has no first amendment rights. It accuses him of incitement of (to) insurrection, which of course is exactly what the turdball did.

    Please do point out the exact sentence in the single article of impeachment that claims what you are supposing, here.

    No, but others involved may have. The President told the crowd that what he perceived to be election fraud allowed them to go by very different rules. Then, he told them to march on the Capitol, where they were met by others, including a few of the Capitol Policemen who opened some of the doors for them (most tried to carry out their duty). In my opinion, he didn't need to say the exact words: "I want you to break into the Capitol." Instead, he said the election fraud changed the rules. I suspect some of his supporters who marched on the Capitol and entered the building after the initial break-in believed the President had authorized it. Too bad he won't be able to issue them pardons.

    He said it "changes the rules." No...it doesn't. There is a pathway through the courts for such appeals...and it doesn't lead through a Capitol riot.
