    Soon as you admit and understand the community was private thus when the mob broke in they were on private property and your sidewalk talking point is moot.

    From your quoted law, “extent he or she reasonably believes such force to be necessary to defend himself or herself or a third person from what he or she reasonably believes to be the use or imminent use of unlawful force by such other person”.

    The legal analysis I have seen show they did not have adequate belief of direct harm. Video shows there was no verbal threat by the protestors until weapons were introduced making the couple in violation of section 1

    They broke into the community its quite reasonable to expect harm from someone breaking in.

    Let me guess Gardners office the same people who tampered with evidence?

    nobody got shot...you can certainly arm yourself and protect your property from a mob that just broke a fence to enter the private property you live on...most reasonable people would be fearful of their lives or harm to their well being if a mob broke a gate down to get on their private property.

    and you can certainly use deadly force under the Castle Doctrine.

    Saying they were on "the sidewalk" is misleading. Yes, they were on a sidewalk, but it was not a public sidewalk. The community was a gated community where the "mob' allegedly tore the gate down. In most gated communities, property lines go to the center of the road and all residences have an easement over the roadway from each lot. So basically, the "mob' was already trespassing on private property and were on the homeowner's property. The fact that the "mob" was well into private property certainly provides justification that they may have been in fear of their lives or, at the least, in fear of damage to their property. I'm not saying the homeowners handled the issue appropriately, but the case will likely go nowhere.

    The trouble is activist prosecutors & judges in that area, and no one has the balls to go after them.

    The local media is also spinning this, making the couple look like the ones who are bad.

    Conspiring to infringe on their civil rights is a Federal Offense. I believe both McCloskeys are attorneys, perhaps they should file suit in Federal Court.

    Regardless, can you point a weapon at someone for standing in your yard?

    Don't know in Missouri, but I doubt a cop would waste their time with someone pointing a gun at people trespassing on their property here in Oregon.

    These people just spent days watching their city burn from wanton violence. They watch a mob walk into their secure neighborhood and possibly even rip down the secure gate. While their actions may not have been wise, it is certainly understandable. If you were on the jury would your find someone guilty for wanting to protect their home? I wouldn't. I couldn't be that big of an unsympathetic jerk.

    Did the people who were threatening them know it was a non working gun? It shows she never intended to use it on anyone but was a ruse to stop them from making her have to.

    If the group was attempting to storm their home then no, I wouldn’t find their actions unlawful. If they were waving weapons at a group that was walking by their home, I would.
