And still one has nothing to do with the other. And I highly suspect the whole wall thing is fake. No home owners association is allowing a ten foot wall there. Thats just not happening anywhere in this country. In fact that's exactly why these kinds of CCNR's exist.

Perhaps you should take that up with the people who wrote the article you linked.

Pure deflection again with you. No surprise there.

The photo clearly show fencing with a brick base. The rich homeowners here won't allow a 10 feet concrete wall.

Your still going to need to prove it's really true. A simple picture in this day and age of technology just doesn't do the job. If it's true ( I doubt it ) it will be easy to prove. So prove it, show me the paper trail.

I never said anything to support that statement. I don't even know what wall your talking about? The same wall? That I doubt even exist, that makes no sense at all.
Is there a fence going in at the Obamas or not.if so then show me the paper trail, it would be easy.....right

That's no at all what the tweet said, and I think our text were confused somehow. I believe that fence is real. Although it still has nothing to do with a border wall at all. It looks like it was more for keeping animals in than bad guys out. I don't think it's any sort of pro border wall argument.

The government cannot appropriate private property without compensation. The government would have to pay a ton of dough to property owners in order to build Bonespurs’ vanity wall through. That’s on top of his $5billion.

Yeah that makes good sense. Thanks for clearing that up. I don't think the stupid wall will be built. The left has no reason at all to be cooperative, it's not like the right did anything but try to make Obama fail.

You a fan of Ben Shapiro? He is predicting that Trump will declare a national emergency, which a court will strike down, then he will complain about the court and the democrats and the government gets funded. The problem is that Ben doesn't explain HOW the government actually gets funded from Trump complaining. Any idea?

Im generally a fan, and have met him in the past.

A court can't strike it down if its declared a national emergency.

Lawsuits would be a delay tactic. There are already means around that, some quite clever.

The fact is Trump does have the authority to do this...

He could, for example, reallocate military spending on construction projects for the wall. One law allows the defense secretary, after a national emergency declaration, to direct the army’s civil works program to construct a structure needed for national defense and use the military budget to do it. Another lets the secretary direct other military services for construction projects. For example, money could come out of the budget for building housing on military bases for service members and into the budget for the wall.

Or, Trump could declare a “state of immigration emergency,” which unlocks an immigration emergency fund. It’s generally supposed to be used to help states feed and house migrants and process their claims, but Scheppele said that it is “vaguely worded enough to permit an edgy interpretation” that could get the funds for the wall. The issue there is that the fund only has about $20 million at the moment, not enough for Trump’s wall.

If Trump’s legal team could identify enough emergency declaration laws to cobble together, they could start to gather the funds.

The White House has also reportedly directed the Army Corps of Engineers to take a look at its budget for potential funds to divert to the wall, including $13.9 billion from a disaster spending bill passed by Congress last year designed for relief projects in California, Florida, Texas, and Puerto Rico.

Uh, no. You're suggesting that there's absolutely no check or balance on the President's ability to declare a national emergency, and that is simply nonsense.

The executive branch needs an actual emergency to declare one; it may not fabricate one, otherwise very damned President would've done that.

Are you incapable of performing real research, or do you simply rely upon fringe "journalists" to inform you?

If what your saying is true, that the declaration of national emergency can't be struck down, what would the lawsuits be against?

This sounds like what Ben was referring to: Title 10 US code section 2808 - Construction authority in the event of a declaration of war or national emergency.

The second one that he mentions is: Title 10 US code section 284 - Support for counterdrug activities and activities to counter transnational organized crime.

Which law is this? This doesn't sound right, as building houses on military bases has nothing to do with construction projects outside of bases, even if it was houses being constructed.

Do you have a link to anything on this or a media article discussing it? Google (from within Australia) only returns one result with the term “state of immigration emergency" in it.

Could the government be funded again from challenging a declaration of national emergency?

    Yes.

Easily, if we simply governed as we should.

Declaring a "national emergency" was never intended to be a means of circumventing Congress, not should it be.
