Obama sends a nomination to the Senate, the Senate ignores it completely...the left is apoplectic, the right rapturous. It is an election year and the GOP Senate would like to survive the election...

The senate can prevent a appointment for a year by staying in a pro forma session. It would be political suicide though.

Not if they don't want to...all they need is to go through a few motions and they remain in session, even though everyone is home.

And McConnel reminds the silly fool that there will be no recesses until January of next year...

If this was not a tragedy I would find this immensely amusing. It really appears the left does not grasp who controls the Senate. I have been listening to them fume and fuss all morning on the talk shows while the token Constitutional token on the boards reminds folk just what the dems can do and what they cannot.

NO congress has ever done that for a year. It would be suicide

If, and I say if, Obama had any morals or ethics he would recuse himself from the appointment due to his intense self interest in the matter. The Court is not supposed to be a political animal.

why political suicide...the left does not elect GOP senators, the GOP base does and allowing Obama to stuff the court would kill any republican senator...political death.

    - - - Updated - - -

why...because the left would throw a tantrum? They throw tantrums already about everything they dislike...the GOP no longer cares what the far left wants

Please do it. It will come up in every debate. You will just hand the presidency back to the democrats.

Better a Justice than holding the Senate for two years. A worthy sacrifice for America...

I hope the GOP does this. You will hand over the presidency AND then we just will appoint a REAL liberal to the court. Double bonus!

He can and should. Any other action leads to condemnation from one side or the other, fortifying his reputation as divider in chief.

    agreed.

not fulfilling their constitutional duty to give a supreme court nominee a fair shot, would make them look horrible and give us the white house.

In your OPINION only. The democrats are plotting ways to steal the election in any case, so why do you care?

He can? Then according to the constitution who should make the appointment? You are being ridiculous

    - - - Updated - - -

Listen I hope you do it. Even McConnell really knows that would be foolish

By "fair shot" do you mean only considering a liberal nominated by a democrat or any nominee? Looking horrible is the purview of the democrats who are already stomping their feet to protest an action not yet taken.

Apparently you psychic powers have failed you yet again. McConnell is within his rights to block an action that he thinks is detrimental to the well being of the country. If you fail to understand this, then you are the problem.

where is the precedent that says "NO SCOTUS confirmations during an election year"?

does this go for all nominations now?

Where is the precedent that says Obama can unilaterally create laws without going thru congress? If he chooses to ignore the constitution in one case he can do so in another. Besides, there is a tradition of not nominating a replacement to SCOTUS dating back to the Johnson (LBJ) administrations. History can be your friend.

Obama hasn't created any new laws.

Kennedy was confirmed during Reagan's last year in office.

Ignoring facts does you no favors.

I cited the LBJ administration, prior to Reagans.

The attempt to rewrite or create a new immigration law, confiscations of guns and passing or denying oil drilling by law are just a few.

Here is s thought for you to consider:

Was the supreme court conceived of as a political body or a justice body? I am not saying that others prior to Obama have not tried to sway it into a political body but that was not how it was conceived. We need to return to that model and, in my opinion, Obama will not attempt it. See the list of his appointments for guidance.

Obama should just nominate 5 of the most liberal people in the world in a row. Let the senate reject all of them. It will crush them in november
