....as are all Israeli annexations- including the occupations of Jerusalem, the West Bank, the Golan and the Shaaba Farms. This is universally acknowledged in law.

I was hoping to avoid this, its part of a thread I am writing. However to explain the legality of the settlements and why Israel is within her rights to settle the areas in question I will post excerpts of it before its ready for prime time. Yes it is lengthy, so bear with me and I hope I have not took the time to do this for it to fall on deaf ears of the usual suspects or have them skim over it then not comment. Well the lurkers and guests etc will know the truth....

    MOF commenting on the above
The American government has a vested interest to make Arab friendly comments at this time. The reason the USA approaching traitor level insults and giving Israel the cold shoulder is Obama’s fault and I hope to God all Christians vote against the fool. Your quote that ‘everyone in the world knows the settlements are illegal' is grossly inaccurate, but maybe you were simply using artistic licenses in grammar? However your claim that the settlements are illegal that is highly debatable. T understand what I mean its necessary to realize international humanitarian law prohibits the forcible transfer of segments of the population of a state to the territory of another state. That only applies if they occupied as a result of armed force (takeover). This standard, which is written in article 49 of the Fourth Geneva Convention, was drafted right after the Second World War ended. The official international red cross’s brief proposed in the Convention said that the principle was intended to protect the local population from displacement and endangering its separate existence as a race of people. A good example of an forced population transfer occurred in Czechoslovakia, Poland and Hungary before and during the WW2. That example has nothing in common to the West Bank and Gaza. therefore to claim the settlements are illegal have no valid basis to rest upon.

So for you or the USA, or anyone to attempt to make a case that the Israeli settlements are a violation of this principle is clearly indefensible. According to the former Under-Secretary of State for Political Affairs penned ; "the Jewish right of settlement in the area is equivalent in every way to the right of the local population to live there" (AJIL, 1990, vol. 84, p.72).

The brief highlighted that the movement of individuals to the territory was voluntary and of course the settlements themselves are not intended to displace Arab inhabitants and they don't in pratice. Anyone who can not determine that the charges of illegal settlements are politically motivated are without a precedent in international law and clearly anyone attempting to make a case that the settlements are illegal are rationalizing at best. Since Israeli settlements cannot be considered illegal, they can not violate the Geneva Convention. So falsely accusing Israel is in the wrong can no longer be used as an excuse for Palestinian/terrorist atrocities, ie ; acts of terrorism and violence against innocent Israelis. They rocket and other attacks are and were crimes against humanity, and worse ie Murder one. I would include war crimes and torture to the list of Palestine/terrorist atrocities. The perps deserve Jail at best and to be dispatched like the dirty rats they are. (I am speaking only of the active murdering terrorists who are murdering as we communicate our ideas).

    Anyway thanks to various web sites and;

I would say nice try at deception, but it’s not even a good propaganda piece its so obviously transparent and or untrue. NEWSFLASH; Israel is within its rights considering the so called Palestinian people 'squatting' etc on Israeli land. I wrote an analysis in an earlier reply (post #126) describing why they are not occupying anything and if illegal violence occurs the Israeli or other suspects are investigated and or charged with a crime by Israeli authorities. When Hamas/Palestinian terrorists launch deadly rockets en mass into crowded cities NO ONE IS CHARGED BY THE PALS OWN PEOPLE!!! At least the Israelis are using legal force to bring the Palestinian/Hamas terrorists that lob thousands of rockets into Israel from the geographical area aka Palestine. That is not the most ignorant part of the equation. First the rockets are launched by the Pals/Hamas, they are aimed at Israel in the hopes of murdering unarmed non-combatants. Then when Israel retaliates or arrests suspects they claim harassment and violence by the Israelis. Then when the Israel hating media gets the report they incessantly continually spin the report to make it seem as Israel was the aggressor!

It’s the same thing if you would choose my house by random knock on my door and punch me in the nose, then attempt to leave. Of course I run you down and return the favor with a punch to your nose. We dust our selves off and call it even. But ! There is always a but or however eh? But the next day in the local paper an article about our fight appears, and it reports that I pulled you out of your car and beat you nearly to death without reason. Of course in this metaphor you are Palestinians/HAMAS and I am the legal forces (not terrorists) Israel. It stinks to high heaven.

SEE POST 127 AND REBUT EACH POINT IF YOU THINK YOUR CLAIM(s) IS TRUE. Please do not cut and paste pieces from world opinion or entire articles from decisions from the useless world court of Anti Americanism. I would like you to comment specifically on the evidence I gave proving that you do not have a case for your claims.

"Prolonged Military Occupation: The Israeli-Occupied Territories Since 1967". The American Journal of International Law (American Society of International Law) 84 (1): 85–86. "The international community has taken a critical view of both deportations and settlements as being contrary to international law. General Assembly resolutions have condemned the deportations since 1969, and have done so by overwhelming majorities in recent years. Likewise, they have consistently deplored the establishment of settlements, and have done so by overwhelming majorities throughout the period (since the end of 1976) of the rapid expansion in their numbers. The Security Council has also been critical of deportations and settlements; and other bodies have viewed them as an obstacle to peace, and illegal under international law."

    UN Security Council Resolution 465

Affirming once more that the Fourth Geneva Convention relative to the Protection of Civilian Persons in Time of War of 12 August 1949 is applicable to the Arab territories occupied by Israel since 1967, including Jerusalem,

    Fourth Geneva Convention
Article 49 (6) of the Fourth Geneva Convention Relative to the Protection of Civilian Persons in Time of War of
August 12, 1949, states: “The Occupying Power shall not deport or transfer parts of its own civilian population into the
    territory it occupies”.1

    Israeli settlements under international law

Israeli settlement activity is a major barrier to our pursuit of a lasting peace agreement in the Middle East. Settlements are not only illegal under international law and in direct contravention of Israel’s Roadmap commitments,

    http://www.fco.gov.uk/en/global-iss...ternational-communityinternational-community/

    Israeli settlements under international law

    Under international law, Israeli settlements
    in the occupied Palestinian territory
(oPt), including East Jerusalem, are illegal.
The illegality of Israeli settlements has
    been recognised by the international
    community including through resolutions
of the United Nations Security Council
    and General Assembly, the High
Contracting Parties to the Fourth Geneva
    Convention and the International Court
    of Justice (ICJ).

I think that about wraps it up.

Well, when the vanishingly small number of radical idiots become a global threat to our existence I'm sure you'll let us know. Until then it's nothing but propaganda-in the same way that Saddam was a threat to everyone's national security. Except that he wasn't.
