Religious Freedom and the Freedom to Discriminate

    In our culture it's assault. And it's a crime. Same sex marriage never was.

    So what? Perceptions can change, just as it did with same sex relationships.

    We need to remember that we have a Constitutionally protected right of Freedom of Religion but there's no protected right to commit acts of invidious discrimination. This is best addressed by the Supreme Court decision in Reynolds v United States.

    Freedom of Religion protects the religions opinions of the person but does not protect the actions of the person based upon those opinions.

    Because invidious discrimination is an action of the person that is in "violation of social duties or subversive of good order" it is justifiable, and well within the scope of power of the government, to prohibit that action. The person's reason for committing the act of discrimination is irrelevant.
