Here's the pertinent bit from the Supreme court

Mu’Min v. Virginia, 500 U.S. 415 (1991). Nor is it a denial of due process for the prosecution, after a finding of guilt, to call the jury’s attention to the defendant’s prior criminal record, if the jury has been given a sentencing function to increase the sentence which would otherwise be given under a recidivist statute. As you can see, the defense had it's chance and either failed or considered other factors more important as they can only reject so many. The judge also followed the required procedure. If Stone gets a new trial it will not be for this.

He very well may.

Be a shame if he got a new trial and it ended with a conviction around Feb 1 2025,

Jury selection will take a very long time, with exacting thoroughness. The judge will not want to repeat the previous mistake.

The sentence was upheld yesterday (40 months) and earlier tonight on Fox he was crying was it a "Death Penalty" because of the Virus.

He should be pardoned immediately and all prosrcutions of any one persecuted by the Mueller " investigation " should immediately be dropped and Democrats should offer simcere apologies to show they aren't bad people.
