FCC proposes $5M fine against conservative activists for robocalls

The Federal Communications Commission (FCC) on Tuesday proposed a fine of more than $5 million for conservative activists Jack Burkman and Jacob Wohl for making over 1,000 illegal robocalls without prior consent.

In a statement, the FCC said it was proposing a $5,134,500 fine against Burkman and Wohl for making 1,141 robocalls to cell phones without consent, thus violating the Telephone Consumer Protection Act (TCPA).

"This is the largest TCPA robocall fine ever proposed by the Commission. It is also the first action where the FCC was not required to warn robocallers before robocall violations could be counted toward a proposed fine, per Congress’s recent amendment of the TCPA," the FCC said.

Last year, Burkman and Wohl were charged in multiple states and sued by New York Attorney General Letitia James (D) for sending out robocalls in an apparent attempt to suppress votes in largely Democratic areas with mostly minority residents.

I heard a recording of the robocall (I don't know if there was more than one) last night. It's despicable. The purpose is to scare the folks who got the call in to not voting by mail. At one point telling the recipients not to give their information "to the man" for various reasons.

The story made me think of a dirty trick Karl Rove carried out for Dubya during the SC primary against John McCain in 2000. The McCain's had adopted a black child so Rove arranged for push poll calls asking about voter's attitudes regarding fathering a child out of wedlock. It was classic Rove.

In any event, I know we all agree these two Trump supporters deserve the record fine that has been recommended. Blatant attempts to subvert an election need to be punished. But.....you know.....as bad as what they did was it's not like they called a state's head election official and asked him to find 11,780 votes to change the outcome.

Funny, the government Do Not Call list doesn't work at all.

I wish they'd crack down on Sally, who keeps wanting to talk to me about my vehicles expired warranty.

The Biden Administration is more interested in retribution then actually governing over the nation whose election HE won! No one gets to talk about Trump apathy and defend Joe Biden lol.

Or having the audacity to ask the DOJ to float a lie about election fraud. <smh>

Question: 1,141 calls doesn't seem like a big enough number to make a dent at the polls. Do you have any theories on why they would even bother to take the risk for such a small audience? Or, is it they were stopped at that number to have the fines imposed?

    Question: What does this mean?

"This is the largest TCPA robocall fine ever proposed by the Commission. It is also the first action where the FCC was not required to warn robocallers before robocall violations could be counted toward a proposed fine, per Congress’s recent amendment of the TCPA," the FCC said.
I'm reading that as the FCC was keeping track of the robocalls but didn't issue a warning until they were ready to take action and impose the fine.

At what point, what upper limit, is the top by which he should be held accountable for his crimes?

Why don't we head on down and let out all our prisoners and dismiss all the pending criminal court cases? We're all supposed to be "equal" right, AN? If Trump (and his slimy sidekicks) get a pass, everybody should get a pass. Let them all out. Well Trump did accomplish that. Too bad he did it for the wrong team (Taliban).

    Exactly...nothing more than politics.

By the same metric "Sally" owes around 70 billion.

Biden weaponizing the FCC as a political cudgel, much like Obammy weaponized the IRS.

    And OP....?
NO, we dont all agree with you.

If you had followed stories about the FCC lately you'd know the members rarely agree on anything. For them to vote unanimously on any matter is a rarity. Trying to deflect away from the egregious nature of what these Trumpette's did by making false accusations about the Biden admin.........well..........it's the definition of a reflexive response.

I can agree that robocalls should be outlawed. They invade privacy. I disagree that what the robocalls say has any bearing on that at all. We still have a first amendment.

Leaving aside your factually inaccurate accusation about Obama, AND that the FCC's decision was not made due to pressure from the Biden admin, don't you think these men deserved punishment?

Leaving aside your factually inaccurate accusation that Obama did NOT use the IRS to target political enemies (a proven fact)

Do you still support Biden doing the same?

If it's so egregious, I'm back to my original question... Why can't they do anything about the other robocalls I get every day?

This is not about the legality of robocalls or the perversion of the 1st A to be used to protect misinterpretations of what is considered free speech. This is a simple matter of two Repub operatives doing something wrong and being punished for it. What the hell is wrong with you people!

I refuse to derail the thread due to your baseless allegation. But please do start a thread on the subject so you can be proven wrong. I will say, however, it astonishes me these lies continue to be circulated years after the initial allegations were made while actual scandals......like Trump's firing of numerous IG's........is forgotten by Trumpette's.

My problem was with the partisanship of your post. I'm all for people being punished for breaking the law.

Focus! The sky is falling and it's all because of the letter behind somebody's name because all X (whatever) is ALL evil, ALL the time. /s

In fairness, you are asking a LOT. Their leader doesn't know how to take responsibility. Why would you expect them to do it?

This law has nothing to do with election fraud. It's a violation of FCC rules for making unsolicited robocalls, Darth.
