I imagine no one will see it coming, or see it going.

Not you, for sure. Others will. The first big meeting involved 90 people from 30 states. The next one will be bigger.

Oh yeah. The young people get it. The old sticks in the mud are still watching TV.

What does art 5 have to do with the SCOTUS? Art 3 Sec 2 grants SCOTUS power to determine the constitutionality of laws as brought before them from lower courts. If your sole argument is the ACA being unconstitutional unless used as a tax, then I agree, that is making law from the bench as that was not the argument in-front of SCOTUS. An Art 5 convention will not change Art 3, Congress will not go there any time between now and the near future (next 100 years).

    My- 90 people.....from 30 states....that is a 'big' meeting........I certainly didn't see that one coming.....or going......

    And what was accomplished?

    - - - Updated - - -

Just a guess- i am guessing the average age at this 'meeting' was 50 years old.

Article V will bypass Congress to fix the government's problems. Among them could be amendments to term limit all jusges, say to one 12 year term. Another amendment might give the Congress and the people the way to overturn supreme court decisions.

It takes 34 states to call for a convention. They met to discuss how to establish the rules.

It would not surprise me. Most of the people who attended are old enough to remember living in freedom.

I think you might be underestimating what is going on in the world. There is a lot of support for freedom and they understand it. It is not being shown on TV, yet.

Do you really think 34 states will muster to do this? and then 38 states to ratify it? Its not going to happen in yours or my lifetimes.

The whole of your issue seems to be the ACA ruling, which would be easier to change through congress with a majority.

Actually, I do. ACA is but one facet of the growing tyranny. And this beats the remaining alternative, an armed revolution.

Then why are there multi-billionaires with mansions on each continent in the world while others are homeless and starving?

Even Marshall recognized that Art 3 Sec 2 would pretty much cause the case to end up with the same outcome.

If you are arguing that the Judiciary Act of 1789 (Sec 13) should be held binding then you are giving to SCOTUS even more power than they have.

I'm not sure you guys actually understand the Marbury ruling.

This seems to be the animus of the issue
Isn't that interpretation required to be within constitutional limitations? If Congress makes a law outside the limitations of the USC and nobody can decide on the constitutionality of that law, then doesn't that make for a tyrannical govt as they could impose on the people any demand or requirement they so choose.

SCOTUS seems to be the last resort for the protection of the people in that since.

I understand that marshall took on powers not granted. That is sufficient for tonight.

    - - - Updated - - -

That would be the Congress and the people acting through the state legislatures. Marshall took power that was never granted. We need to fix that.

Oh lots of support for freedom.

Not much support for the foolishness you believe in.

I understand it like Lincoln did. Supreme Court Justice Roger Taney had no more authority to declare Dred Scott a slave than I do.

You think you are free? Free to do what without getting permission from authority?

Government's only duty is only to protect property, liberty, and peace. That's it.
