Perhaps we are reading different OP's. The one I am reading is the first post of this thread.

 

Suspected of crimes is the only reason a person is before a judge in the first place right? The suspects have a right to defense and the prosecutors have a duty/requirement to prove them criminals. Every person arrested for illegal entry into the country will be afforded a hearing. Those that overstay visas can be deported without due process. The immigration law in the US is very clear, anyone not here legally has committed a crime no matter how that person conducts themselves.
