    A misdemeanor under federal law is punishable with jail. Jaywalking isn’t a federal crime. It carries up to a year. A second offense or illegal crossing is a felony

    I doubt it was given to circumvent a clearly decided will of Congress to not fund the border monument past what they agreed on.

    Since this will likely be challenged in court, here's some reading I found regarding a court battle over Harry Truman's use of emergency powers to nationalize a steel mill, and the court that ruled against him. While not the same situation, there are certainly parallels.

    However you are correct, the penalty and fine for simply crossing the border illegally is minor.

    The issue is what happens after that.

    It is a Federal Crime, a felony, to create fraudulent documents to obtain employment. Nearly every illegal alien uses forged documents to survive in the US.

    The question was not what you doubt, but why was the power given to the Executive Branch. And I would be careful about following the tribes reference to the southwest border as a monument. Everyday Americans take National Security and protection of national sovereignty a bit more seriously than the absurd reference is conveying, and the open borders inference is confirming.

    I have no doubt this will be challenged in court. The leadership of the New Democratic Party is more interested in opposing everything the President is doing, than conducting the business they were elected to do.

    As the argument in the EFF link indicates, the question of whether Congress has sent a message, or has failed to respond adequately, will likely be the basis for the lawsuits the hard left will be bringing against the Presidents actions.

    Since the liberal media, and the NDP leadership has been calling the activity on the border a crisis for at least two years, it's going to be difficult to backtrack and now claim it's no big deal.

    The wall is absolutely a monument since it won't actually stop the primary things Trump has claimed it will, like terrorists and drugs and criminals. It's a physical object he can put his name on, which we all know is something he likes to do. And you're confusing humanitarian crisis with national emergency. There is indeed a humanitarian crisis, but his national emergency doesn't do anything about it except try to put the humanitarian crisis out of sight and mind. So one thing is not the other because the latter doesn't address the former. You're making false equivalencies.

    And I'm sure you're aware that even many in the Republican party oppose using an emergency declaration in this instance, for the same reason everyone else does. It not only cheapens what a national emergency even is, it's also a blatant attempt to circumvent Congress after they decided not to give Trump the money he demanded, money that we were all told was supposed to be coming from Mexico in the first place.

    Use all the monikers and talk radio talking points you want, but it doesn't change reality.

    National borders are not monuments to an individual. If you can't get past that, there is little to discuss.

    The United States has been facing an invasion from unknown people from foreign Nations. They are not respecting the border, they are breaching the border. No Nation has ever survived by allowing an invasion from other Nations to go unchecked.

    How many miles of the Southwest Border contain no man made deterrence to crossing? Where does the majority of illegal crossings take place?

    How serious is the problem of human trafficking, drug smuggling, terrorist groups? The DHS/CBP has reported extensively on the subject. The liberal media has declared what is going on at the Southwest Border is a crisis for a number of years.

    I haven't been using monikers or talk radio talking points. I've been citing information provided by the US Government.

    Seems all you have are monikers and memes from far left sources, so there is little reason to expend any more energy here.

    Quite right, borders are not. Giant useless walls that exist solely to put Trump's name on however, are.

    Human trafficking, drug smuggling, and terrorist groups are not going to be stopped by the wall. Neither will the humanitarian crisis be addressed by building a barrier in front of it.

    The wall exists for Trump's ego and to keep the poor people out. Is it any wonder that a billionaire president's biggest fear is poor people?
