And that would be illegal and unconstitutional to do to the prisoners held at Gitmo.

It wasn't a mandate, it was a recognition and protection of US forces in Iraq.

SOFA's are ALWAYS subject to change and its understood that the leaders in power can revise them as needed.

Obama ran on Iraq being the "bad" war, and wanted to be able to say he ended the war there-except he expanded and prolonged it.

The excuse he used is the same you are peddling-blaming it on the other guy.

They get far too much protection once they are brought onto American territory.

Thats why its best to kill em where they are fighting.

    Much less mess that way.

The Iraqi government refused to revise the SOFA unless an amendment was added allowing US troops to be tried in Iraqi courts.

Should Obama have signed a new SOFA with that agreement?

Except a large number of the guys in Gitmo were not caught while they were fighting. A significant number of them weren’t even in Afghanistan.

Obama's legacy is one of terrorism flourishing, transgender restrooms, and record child poverty.

And his supporters clapped like seals and are curious why Trump is in the White House.

    "Custody" implies capture.

    Kill on sight.

    No prisoners.

Wasn't it the US military? Even if it wasn't or even if it was a mistake, why couldn't he simply recapture him?

KSM is one of the guys that your plan would have had the US kill on sight, yes?

Obama should have been a better negotiator, like Bush was.

He wanted out, and any excuse would do.

At the time of the SOFA negotiations with Obama, they had heard very little from Obama for years.

They didn't know what he was thinking and he didn't even give them time to gain more support.

Its the foreign policy equivalent of Obama's "pen and phone".

He couldnt get congress to play along with his agenda (because he had squandered his political capital, caused record defeat for his party, and belittled and misconstrued the other side) so he had to go to executive orders, which were largely overturned by Trump.

Terrorists aren't protected by the Geneva convention.

Bush couldn’t get the Iraqis to drop that demand. What makes you think Obama could get them to?

For that matter, what evidence do you have the Iraqis were even willing to drop that demand?

Its a bit different in this case, because he was a high level terrorist.

In that case, if the intelligence obtained may be greater it might be worthwhile to interrogate.

    But the average johnny jihad?

    Bullet in the face.

And KSM could be shot on sight legally.

Or a bayonet could be used-Im flexible like that.

KSM was handed over by Pakistani ISI. At no point could the US shoot him on sight legally.

You realize your plan would gut operational intelligence, yes?

The demands were because of the Arab spring-which happened after Bush's term and which was also mishandled (and expanded) because of Obama.

What kind of genius helps overthrow the moderates who were maintaining order (Egypt and Libya) in favor of the islamists?

While at the same time staying silent when moderates in Iran are protesting their own islamists/theocrats.

Obama's stupidity is stunning, and it was the "kindling" of ISIS, which he also blew.

Then there was the time John Kerry went to Pakistan and told them the USA would no longer be using drone strikes there, and Obama had to correct him.

The Iraqis were demanding to be able to try US troops as a requirement for extending the SOFA while Bush was still in office. He couldn’t get them to change it.

If he was such a better negotiator than Obama, what makes you think Obama could get them to drop the demand?

And again, where is your evidence that the Iraqis were even willing to drop that demand?

Mohammed was captured on March 1, 2003, in the Pakistani city of Rawalpindi by a combined operation of the US Central Intelligence Agency (CIA) and Pakistan's Inter-Services Intelligence (ISI). Immediately after
his capture, Mohammad was extraordinarily rendered to secret CIA prison sites in Afghanistan, then Poland, where he was interrogated by U.S. operatives.[8] By December 2006 he had been transferred to military custody at Guantanamo Bay detention camp. In March 2007, after significant interrogations, Mohammed confessed to masterminding the September 11 attacks, the Richard Reid shoe bombing attempt to blow up an airliner, the Bali nightclub bombing in Indonesia, the 1993 World Trade Center bombing, the murder of Daniel Pearl, and various foiled attacks, as well as numerous other crimes.[9][10] He was charged in February 2008 with war crimes and murder by a U.S. military commission at Guantanamo Bay detention camp which could carry the death penalty if convicted.

Didn't I just say that an exception would be made if they were high level with lots of intelligence?

Interestingly, the first day I flew after 9/11 was the day of the Richard Reid shoe bombing attempt.

I flew from LA to DC and it was brimming with security. Everyone seemed bug eyed, including my dad who was waiting to pick me up.

I assumed this was the new normal after 9/11 but my dad told me about the shoe bomber.

Already provided earlier in this thread but the gist is that those protections only apply to conventional combatants fighting for a nation.

Terrorists are neither of these things and therefore warrant no such protection.

You don’t know the intelligence value of your “average terrorist” until they’ve been interrogated. Nearly every intelligence breakthrough we had when I was in Iraq came from interrogating low level guys.

So if a group of terrorists surrendered, waving white flags and all, we can execute them all on the spot?

KSM was known to be a high level terrorist and the US was trying to capture him as early as the mid 90's, before he began planning the 9/11 attacks.

Tony taliban may indeed by a good source of local intelligence, helpful on the tactical level perhaps but not game changing.

We already knew about the terrorist killed by the major. The locals knew. Everyone knew who he was and what he was about-including killing Americans.

    Good shoot.

Yup. And I'd argue we should do it more often to prevent these legal headaches.

    Same for pirates.
