Bull. The overwhelming majority of people "prevented" from buying guns are "prevented" because of mistaken identity or commonality of names. Unconstitutional infringements on their rights. You wouldn't know dangerous if it walked up and slapped you across the face.
1. It's finding an FFL who will actually do private sale background checks. It's not mandatory. In Colorado not all FFLs will, and some on only on certain days of the week, and if you live in a more rural area, it might be a 50 mile drive. 2. It can cost upwards of $50 to pay for the background check and transfer, and taking $50 out of my pocket to check to see if my CCW holding or cop badge wearing friends are prohibited persons is harassment in my book. 3. It's a law that cannot be enforced. 4. In Colorado, checks use NICS and CBI databases, and on gun show days the time can stretch into hours. Heck, during panic buys I've had checks stretch out to 10 days.
Wrong. Most of those "prohibited gun buyers" were actually honest citizens erroneously stopped because of name commonality or even because they had security clearances.
Simple truth, Ron, whether you like it or not. I've worked at a gun store, and I can tell you that ten denials were overturned on appeal for every 1 that blocked an actual criminal.

We don't have enough ATF agents to arrest the 55,000 actual criminals who commit a felony trying to buy a gun and give the government their name and address, and you think that we have enough to conduct random stings? It's the prohibited buyers they out to be trying to arrest. Since stings can't possibly catch sales between friends, what is the purpose of making sales between friends a crime?

The ATF shouldn't exist. The government actually was ready to disband it, but when word of it reached the heads of other agencies they informed Justice that not one other agency wanted any part of being forced to hire ATF agents due to their unprofessionalism, arrogance, and contempt for fundamental Constitutional principles. Since they couldn't just release the agents, they left the agency in place; more's the pity.
In Colorado, the background check plus the transfer fee can run up to $50 depending upon the FFL and how much they want to do them. There were three other points in my post. By ignoring them, you're not debating the issues, either.

Exactly so. They were created for spurious reasons and continue to exist for spurious reasons. It's time to disband them; most ATF agents aren't fit to wear the badge.

they would respond to online and newspaper ads and make sure a NICS check is performed before the sale. if no NICS check is performed, guy gets a big fat fine

Oh, that'll stop criminals from getting guns all right. That's much more important to our safety than arresting the 55,000 felons every year that we actually catch with a background check. What about the millions of transactions that they miss? How would those be enforced after the fact?
