Insurrection is a violent uprising against the government to take control of the government.

I never said they were smart or competent. Their goal was to prevent certification allowing their political party to retain control.

A bunch of dumbasses rioting at the capital because they didn't win an election isn't an insurrection. Its just idiots having a temper tantrum.
You have to have some ability to take down the government to be an insurrection like a military force to support your effort.

This would mean (first) killing all the Capital Police that stand in your way
Then defending your position from the military to take over the Capital and the country while installing your appointed leader.

If this is an insurrection, trying to stop the vote, then the people who were trying to break down the doors of the SCOTUS to stop Kavanaugh's confirmation were insurrectionist as well. Which is ridiculous.

The rioters had no way to stop the election process
They had no way to overtake the Capital
They had no way of defending their position at the Capital
They had no way to take over the Government of the US
They had no way to put their own leader into power.

To attempt an insurrection you must have some capability to be successful. Like armed insurgents with military weapons, vehicles, and air support.

As far as I am concerned, the Capital Police should have used more deadly force against the rioters. That would have sent them all running like the cowards they are. But these rioters have become emboldened to attack law enforcement to get their way through months of attacks on the WH using frozen water bottles, rocks, explosives, and gas against the Capital Police with no recourse against them.
Months of riots where these Mayors REFUSE to allow the NG or local law enforcement to attack or subdue these rioters.
Like taking over the city of Seattle. Allowing a bunch of armed rioters take over the city? Are you kidding me?

They should have been met with military armed resistance and taken out.

So this is what you get when rioters are allowed to run rapid through out DC and the 24 Democrat cities. You get more rioters, more looting, more businesses burnt to the ground, more Americans murdered.
If you want to stop it for good, allow our law enforcement to respond to deadly force with deadly force. Then watch how fast this all ends.

It doesn't matter what these idiots thought. It matters what they are capable of.
You know and I know and everyone on the planet knows, there is no way they could prevent the certification allowing their party to rule.

 

So something isn’t a crime if the individuals were not capable of carrying it out to fruition but attempted to do so? I usually use the word attempted but it is just splitting hairs at this point.

Intent is absolutely relevant

 

You can try and apply all the generalities you want but there are different charges for different applications.
And there isn't some one size fits all legal claim you can apply.
They aren't being charged with insurrection because it doesn't fit the statute.
No attorney is going to stand up in front of a jury and try and make the claim (to fit the statute) that a few hundred rioters attempted the impossible task to take over the capital, and the government and the country and the US military to install their own leader while bravely waving their deadly flag poles.

An attempted insurrection would have tanks, military gear, and air support that was put down by US forces.

All you have here is a bunch of rioters who went home after a two hour temper tantrum.
