Countless times we have examples of Democrats flouting the law and abusing power with no recourse,” she said in a statement. “Democrats continually weaponize the bureaucracy against Republicans. This raid is outrageous. This abuse of power must stop and the only way to do that is to elect Republicans in November.”

    We'll need to prevail in 2022 to start the process of reining in the Lawless Thugs in the FBI and DOJ and we'll need to prevail in 2024 to complete it.

    Nothing else will work, so nothing else will matter. It's the 30 year anniversary of the assault by 400 agents on Randy Weaver's family where they killed his wife and son. They would love an excuse to conduct a massive assault on those they will lose to in less than 13 weeks. This is desperation on their part. Don't take the bait. Stay calm, stay cool, vote.

    It's as though you live on some other planet where you are not aware that she destroyed 30,000 subpoenaed emails and had classified information on a private server

    Maybe they will extend some emergency and declare it as such that precludes an election in 2022 and 2024 and the removal of as many civil liberties as they need to do to get coerced public compliance with their will. They may be prepared to go all in to preserve their power. They are possibly prepared to try to end the republic and suspend the constitution rather than allow the working and middle class to elect Trump President again

    If they were that confident, they wouldn't be acting this desperately. The Constitution is crystal clear, the Presidential term expires on Jan 20, at noon, without the State Legislatures certifying 270 votes or more for him to continue. He has no emergency powers to extend that. There is zero ambiguity on that point. The Fake News press drums up this crap every election year when there is a Republican in the WH, it's an endless loop of bs. Few are fooled by it.

    Let's stay focused on 2022 for now.

    Unless of course, those documents put Trump in a very compromising political or legal situation on taxes, January 6th and so forth. Then Trump does what he has always done, delay, delay, delay.

    We have seen this from the small business owners who sued Trump when he build Taj Mahal and other properties for contract disputes, Trump University, and his other scandals before and during his presidency.

    Declassification of documents is not based on who is president, it is based on the governing authority of those documents, namely the agency or department. NSA has the exclusive authority to declassify documents. They will do so at the President's request, usually per an EO, but requests are not commands though. Second, with archived documents, anyone can request declassification using the FOIA process of the mandatory review process per EO 13526. The agency that oversees this is the ISOO. Furthermore, in EO 13526, there are two types of classification, automatic, and exempt. Automatic is a time frame, I believe, 25 years. These is most government-classified documents. Then there are exempted documents, which can last up to 75 years depending on the reason. However, the governing agency, the DOJ and the National Archives have a say in what is and what is not declassified, coordinated by the ISOO.

    The President has inherent, unhindered declassification authority. If this the claimed reason for the raid, it's a pretext that will only be convincing to the uninformed or fools.

    If they simply wanted the documents in question back, the sensible thing to do would be to issue a subpoena.

    And armed raid? Sandy Berger, as Clinton's former National Security Advisor, smuggled out classified documents by stuffing them in his pants. Funny thing, no armed raid, they just asked for them back.

    I'm surprised at how reckless and pathetically desperate the DOJ and FBI are. They are showing a level of reason far below what is required for the office they hold. But, that's not something that can be dealt with until after the election, so first things first.


    "The more appropriate action would have been for a grand jury to issue a subpoena for any boxes of material that were seized and for Trump’s private safe that was opened. That would have given Trump’s lawyers the opportunity to challenge the subpoena on various grounds — that some of the material was not classified; that previous classified material was declassified by Trump; that other documents may be covered by various privileges, such as executive or lawyer-client."

    First the election, then we get to the bottom of this.

    "It is true that a president or former president is not above the law — but neither should he or she be below the law. Precedents established in relation to Democrats must be equally applied to Republicans. On the face of it, this standard has not been met here."

    Jonathan Turley points out yet another precedent shattered in the raid:

    "While the Presidential Records Act requires the preservation of such documents (and the removal was likely in violation of that law), it is relatively weak on enforcement elements. As shown in prior administrations, presidents have long chaffed at both the limitations or disclosures imposed by the Act."

    The 1978 law requires that any memos, letters, emails and other documents related to the president’s duties be preserved for retention by the National Archives and Records Administration at the end of an administration."

    "Those laws have never be used against a former president.The allegation of the removal of classified material can trigger other laws beyond the PRA that bar the removal of such material without authorization and without proper protections. Those laws were raised with regard to former FBI Director James Comey removing FBI material and then leaking information to the press. Comey clearly violated federal law but was not prosecuted."

    "President Bill Clinton’s former national security adviser Sandy Berger, the violations involved stuffing classified material into his pants and socks to remove them from the archives and to retrieve them later. Berger was spared any jail time and allowed to plead to a misdemeanor. He did not even loss his security clearance permanently and was given a three-year suspension. Likewise, General David Petraeus was accused of giving access to classified information to his alleged lover and was also given a generous plea."

    Their explanation is ridiculous, clearly it was a pretext "for a completely different allegation of criminal conduct."

    No, he does not. He has the authority to classify information, in which he now becomes the originator of the documents that are now classified. But with other agencies in the Executive Branch, like the CIA or NSA, have the authority if it is that agency that classified the document becomes the primary agency to declassify the document. Furthermore, John Turley is not exactly true in his statements. The Presidential Records Act, is quite clear, especially in the 2007 amendments of who has ownership and so forth. All presidential records must be preserved, yet DJT allegedly tore up said records while in office. Trump has been caught circumventing those requirements such as giving his private cell phone number to foreign leaders, no detailing phone call conversations, and so forth, which is a violiation of the spirrit of the Presidential Records act.

    Shattering precedents is not, I repeat, not a violation of the law. Yes, Comey did violate the law when he removed documents. However, the question still remains, why didn't the Trump Administration DOJ prosecute him? After all, Sessions was in charge, then Whittaker, then Barr. Not one charged him and they could have. After all, these "were the finest people" that Trump chose and Trump never makes a mistake, does he?

    They have derivative authority from the President, the President has inherent constitutional authority as Commander in Chief.

    If you are buying the pretext that this massive armed raid was over Presidential Records Act or "classified" docs, you are pretty gullible.

    This was yet another desperate pathetic act by a bunch of clowns who are just sure that Trump is guilty of something terrible, but, every place they assure us that the smoking gun lies, always turns up to be a dry hole. This time they came up with a pretext to toss the home of the former president and leading contender for the GOP nomination. Hell, they illegally spied on him the last time he was a candidate, why should we be surprised at an armed raid of his home?

    These folks are pathetic failures and they continue to escalate apparently thinking that if they do something even more outlandish that they will finally hit "pay dirt". They are hangdog gamblers on an endless losing streak that will continue double down until power is wrested from their disconsolate fingers.

    First the election, then we'll get to the bottom of this.
