Sherriff Joe Arpaio is filing an appeal to a highly suspect Federal court ruling by a SINGLE JUDGE, citing the outspoken Arizona Sherriff for "racial profiling Mexicans" (Mexicans are now a "RACE???!!"), by a Federal judge.

Arizona sheriff Arpaio says he will appeal racial profiling ruling

PHOENIX (Reuters) - Arizona lawman Joe Arpaio, who styles himself as "America's toughest sheriff," said on Wednesday he would appeal a federal court ruling that found his agency had engaged in racial profiling of Hispanic drivers in its zeal to crack down on illegal immigration.

"One hundred of my deputies were authorized and trained by the federal government ... to enforce federal immigration laws," the Maricopa County sheriff said in a video posted on YouTube.

"Now the federal court has ruled that federal training was unconstitutional and it led to racial profiling. We will appeal this ruling," Arpaio said.
    .

Arpaio has been a lightning rod for controversy over his aggressive enforcement of immigration laws in Arizona, which borders Mexico, and an investigation into the validity of President Barack Obama's U.S. birth certificate.

A federal judge ruled on Friday that Arpaio had violated the constitutional rights of Latino drivers in his crackdown on illegal immigration, and ordered him to stop using race as a factor in law enforcement decisions.

The ruling came in response to a class-action lawsuit brought by Hispanic drivers that tested whether police could target illegal immigrants without racially profiling U.S. citizens and legal residents of Hispanic origin.

U.S. District Court Judge Murray Snow found that the sheriff and his office had violated the drivers' constitutional rights and ordered them to cease using race or ancestry as grounds to stop, detain or hold vehicle occupants.

Arpaio said in the statement that he had ordered his deputies to stop detaining people they believed to be in the country without authorization whom they could not arrest on state charges.

Counsel for the plaintiffs - five Latino drivers who said they had been stopped by deputies because of their ethnicity -hailed the ruling on Friday as "an important victory" that would resound far beyond Maricopa County.

Arpaio, who has always denied charges of racial profiling, has been the subject of other probes and lawsuits. In August, the U.S. Attorney's Office in Arizona said it had closed a criminal investigation into accusations of financial misconduct by Arpaio, and it declined to bring charges.

A separate U.S. Justice Department investigation and lawsuit related to accusations of civil rights abuses by Arpaio's office is ongoing.

Arizona has been at the heart of a bitter national debate over immigration since Republican Governor Jan Brewer signed a 2010 crackdown on illegal immigration that was subsequently challenged by the federal government.

The U.S. Supreme Court has allowed to stand a part of the law that permits police to question people they stop about their immigration status.

The most corrupt administration in HISTORY, has apparently not forgotten th FAILED FEDERAL INVESTIGATION of Arpaio, and has used one of their judiciary FLUNKIES to try to get their "dirty work" done.

Arpaio will TRIUMPH, of course, as the USSC has ALREADY UPHELD the law under which he LEGALLY INQUIRES rgerading the IMMIGRATION STATUS of those his deputies stop.

Good let him. The appeal will fail. The federal government should arrest and charge "America's most corrupt sheriff" with violation of civil rights.

Sorry racial profiling is unconstitutional. The judge (a bush appointee) made the correct judgment. Now time to lock this criminal up.

The civil rights act, the 13th and 14th amendments. And are you seriously saying Mexican isn't a race? Racial profiling is illegal and is NEVER tolerated. Those are the facts. Arpaio violated the civil rights of American citizens and needs to be jailed for at least 10 years for his crimes.

Anthropoligists are "seriously saying "Mexican" is not a race", not just me. It ISN'T .

No one was DENIED any right as listed under the 13th or 14th Amendments. The USSC has already ruled that ARPAIO (etal) are free to enquire about the immigration status of WHOMEVER they stop...that includes MEXICANS.

Why do you do this? Filing an appeal does not change a ruling. Making a comment about something that the SCOTUS allowed does not change the ruling. Do you realize that the ruling stands unless it is overturn. Can you come back when you have real news?

What are your solutions for fixing our economic problems?

??? Moving too fast for you? Why are you posting here, if it is not of imoort to you?

    Lonely?

The USSC ruling will serve to support Arpaio's appeal of the BULLCRAP Ruling by Judge Snow.

CLue: The USSC PREVAILS over the Fed. District Court, and it is THAT USSC ruling that will make Arpaio's case.

    OBVIOUSLY.

    Confused?

ObamaCo shopped 3 judges before finding one who'd give the go ahead for journalist Rosen's unconstitutional anal exam.

I'm sure this most corrupt administration ever shopped this scumbag as well.

Progressive leftists scream "Power to the people!!".....
and when the people disagree, they scream "Power to the [corrupt] courts!!"

    frauds, the lot

    For enforcing federal immigration laws?
In Maricopa county, the epicenter for illegal entry into our nation from Mexico (perahps you've heard of the phenomenon), now it's illegal to
"profile" Hispanics...the very people breaking federal law by the hundreds of thousands yearly.

Only in progressive world could such stupidity pass as "thought".

I think this was a witch hunt against Sheriff Arpaio from the beginning. He should win his appeal.

So you are saying that the eqall protection clause does not protect individuals from racial profiling?

You might want to read this before posting again.

The constitutional law requires that police have a reason, other than race or ethnicity, to stop a person, search the person or their property, and detain that person. This applies to the 4th amendment to unreasonable search and seizures. The 14th amendment makes sure that no specific group, based on religion, ethnicity, race, creed, nationality, age, etc is not targeted by police or law enforcement simply because of that specific attribute. Again, there has to be a reason. Not every Hispanic is an illegal. Not every Muslim is a terrorist. And not every White, middle aged adualt is an evangelical Christian.

Nope. What is "racial profiling"? And what "race" are Mexicans? Same "RACE" as Arpaio..right?

Not every Mexican in Arizona is illegal, but EVERY ILLEGAL IN ARIZONA, IS MEXICAN.

It's called "common sense", and the USSC has ALREADY UPHELD what Arpaio is doing= he will PREVAIL on appeal.

Racial profiling is not just about race. It is any group in Title VII of the 1964 Civil Rights act. That is why I also said ethnicity. Mexican is a nationality, also protected in the 1964 Civil Rights Act.

It doesn't, because racial profiling is not, ipso facto, a denial of equal protection, obviously.

There may be a federal statute that requires that LE officers pretend to be color blind, but the Constitution clearly does not.
