Regardless of whether or not the documents were declassified, federal law requires those documents go into the National Archive. In fact in January the National Archive received some of those records back, but not all of them, and some of the records they did receive back had been shredded. When the National Archive got word in February that there were still more records being held in Mar-a-Lago, they contacted the Justice Department to look into the issue. I'm definitely no legal expert, but if this is simply a matter of the documents not being returned to the federal government to go into the National Archive, that is considered to be a pretty minor offense. From what I have read the penalty is a fine, and possible prison time, but in all likelihood it would probably just be a fine.

However, if there were in fact documents in the mix that were still classified, this would definitely be considered a felony offense. As noted in the OP, this became a felony offense in 2018. The big question is were there any documents in the mix that are still considered classified. It is true that the president does have the power to declassify documents, however this isn't true for all classified material. In particular, the president does not have the power to declassify nuclear documents. If the reports are true that there were nuclear documents in the mix, this could potentially be a very serious violation of federal law.

At this point in time all this nuclear document stuff is up to speculation, nothing has come out that would verify that any of the documents were still classified material. So far, all that has been verified is a warrant was issued to retrieve documents that belonged to the federal government, and FBI agents did go in and retrieve those documents. Nothing has come out to show that any felony was committed

I don't believe any of it. It's a fact. End of conversation. If you don't like it, I could care less.

Trump is no longer president. That's what the Espionage act is for as it applies to possession of information related to the national defense that could be used to harm the U.S. or aid a foreign adversary. This law applies to someone who, like Trump, initially had lawful possession of such information but who, after their time in office ended, refuses to return it to the government.

If you think Trump is immune to the Espionage act, I sincerely doubt it.

False, the president is the ultimate law provider for classifying documents. ONLY the president writes the laws on documents classification and has the ability at will to declassify any document he sees fit. No matter what their classification is.
You guys should take a class. Really. lol

False, The President and VP are the only ones impowered by the constitution to mandate laws governing all classifications. There is no such power in existence that over rules this power.

I think ALL politicians are guilty, period. Politicians are ruining our country and I am appalled and beyond angry that any taxpaying citizen would defend them.

I do believe there are well meaning politicians that have tried to make a positive difference that are right there witnessing what's happening first hand. In my opinion they are just as guilty, perhaps more guilty because they they see what's happening and do not have the courage to inform the citizens of our country.

As for hillary, I think she believes that she is better than the average citizen's of our country. She believes she can do no wrong and will never be held accountable like so many of our politicians do.

And frankly as long as voters/taxpayers continue to vote for and defend politicians like her the taxpaying citizens will always loose.

Your country is completely divided with illegals flooding in daily at taxpayers expense, the people on this site that voted for biden to be president have nothing positive to say about him, and their only defence is to still attack President Trump, who has been voted out of office, and you choose to try and be funny. That says everything that "we the people" need to know.

The sad truth is: the taxpaying citizens of this country are spending WAY too much time fighting with each other. And because of that the corrupt politicians are in total control.

Nobody likes what's happening, how about we start letting these corrupt politicians know we are done putting up with their s**t

I know, I know: it will never happen though.

People today are more interested in arguing for "their side" than focusing on what's good for our country.

Once again: politicians are the problem, not the solution

But, it doesn't address the question postulated. Is the Holy Papa Catholic? Can you answer for the other poster?

Certainly, whatever is required for one's comfort zone is fine by me since the Holy Papa is most defo Catholic! The question was rhetorical.

Fresh, President Trump is a BUSINESSMAN, a very successful BUSINESSMAN, that has never had to rely on lying to the low information voters of this country to make his living. He is a businessman that has had to answer for his mistakes.

He's not some politician who gets a free pass on corruption and using his political power to enrich his druggie son and the rest of his looser family from voters like you.

When has any worthless, corrupt, politician had to answer for their mistakes?

They don't, they get a pass. Thanks to voters like you.

I'd vote and stand up for the man who has to fight before I'd ever even consider voting for a worthless, career politician who even his own supporters cant find anything positive to say about what he's done for the taxpaying citizens of this country.

Tell me: are you satitisfied that you made the right decision to vote for biden considering the taxpaying citizens current inflation dilemma?

Some of your fellow Americans are currently homeless at this very moment due to the fact you voted for biden.

Are you really ok with that?

No fresh, he's a businessman. And that's why he's still enormously popular compared to the corpse you voted for.

So, once again: Tell me: are you satitisfied that you made the right decision to vote for biden considering the taxpaying citizens current inflation dilemma?

I notice how you rely more on insults than facts.

So your saying that all those executive orders biden signed on his first day on office (executive orders that mainly reversed most of President Trump's policies) had absolutely no effect on our country's current situation?

Ahhh, yes the debt. Mr. Fresh you conviently forgot to mention President Trump was also faced with the deadliest virus in history and was forced to raise the debt to provide money for the citizens of our country that was shut down due to the deadliest virus in history.

Again I have to ask due to the CRICKETS on your end, could you please tell me if you are satitisfied that you made the right decision to vote for biden considering the taxpaying citizens current inflation dilemma?

    My thought exactly

The amount of trump supporters who are acting as if he has already been found guilty convicted of a crime……..

lt is almost as if in their heart of hearts they think he is guilty
