I wish I had that much confidence in the Justice Department under Reichsführer Obama. Neither Lynch nor the FBI will do squat unless he blesses it. Rumor has it that he hates the Clintons' guts and that he wants good old 'Joe' to proceed with his anti-Constitutional version of Fed Reserve-puppet economic policies and socialized medicine.

Obama has kept the military from disemboweling Bergdahl, and he wouldn't hesitate to use his "pen and phone" to do the same for Hillary... if the Clintons are willing to pay Obama's price (whatever that may be). But she should be indicted, tried, and found guilty... the statutes governing the handling of classified information are very, very clear! If she gets away with this then the whole justice system in the United States is destroyed.

Didn't I see you lauding Alan Dershowitz some time back?

Here's an attorney who would like a few words with you.

    Roll the tape:

"To indict, you have to show that it was marked 'classified,' not that later on it became classified," he told "Newsmax Prime" host John Bachman. "I think everybody agrees that, as far as we know, there have been no emails that have been marked classified."

"There's an enormous difference between charging a former secretary of state with a crime and criticizing her judgment," Dershowitz said of the Democratic presidential front-runner. "To have a crime, you have to show that at the time she did it, she knew that what she was doing was in violation of the criminal law.

"The fact that you find emails that may later be subject to after-the-fact classification is not the basis for a criminal charge."
Dershowitz: No 'Realistic Possibility' of Hillary Charges in Email Scandal | Newsmax

"The law requires that you have to know that what you're doing is illegal, there has to have been classification notifications," he said. "She was right when she said that there was nothing illegal about what she did at the time she did it and nothing that she had on her email was marked classified.

"That doesn't mean it was good judgment," Dershowitz cautioned. "She's now acknowledged that she wished she hadn't done it. But the case is over as a legal case for all intents and purposes.

Alan Dershowitz: Clinton 'in the Clear' With Private Email Use | Newsmax

"Hillary Clinton can't be held responsible for forwarding emails through her private server if they weren't marked as being classified, Harvard Law School professor Alan Dershowitz said Thursday. "If it was not marked classified, you can't blame her for following usual procedures of the State Department and sending unclassified material over a private server," Dershowitz said. "That is why the Justice Department is exploring this to see how to prevent it from happening in the future. And I think what we're doing is looking forward to make sure this never happens again."

But, meanwhile, it's not fair — or constitutional — to look backward and hold Clinton responsible "in any way for rules not in existence at the time, as the Constitution prevents the courts looking backward" to impose criminal liability on conduct that was innocent and not criminal at the time it took place."

    Here we go again.

"IC IG made a referral detailing the potential compromise of classified information to security officials within the Executive Branch . The main purpose of the referral was to notify security officials that classified information may exist on at least one private server and thumb drive that are not in the government's possession .

An important distinction is that the IC IG did not make a criminal referral - it was a security referral made for counterintelligence purposes . The IC IG is statutorily required to refer potential compromises of national security information to the appropriate IC security officials."

That's straight from the Office of the Inspector General.

The FBI used the term "law enforcement"
    Take it up with them.

Amazing that Hillary would discuss classified info with someone she shouldn't have been.

Amazingly, she said she never sent any Emails to Blumenthal. That she sent all of her emails to State.....then got caught with not doing so.

Amazingly, the E-Mails containing classified info was on her private server after she deleted 30k of emails from her private server. In Which now her tech guy has pleaded the 5th and refusing to cooperate with the FBI.

Amazingly, now they have caught her aides Abedin and Mills also sending Classified material over their private accounts.

Indeed....its quite amazing. Just ask Russia and the Chinese.

That was before Dershowitz knew that the Justice Dept filed before the court. So again check with the attorney about the filing.

    - - - Updated - - -

I did too from the same link.....what part about filed before the court, didn't you see? In order to file before the court any letters. There has to be a criminal case going on. Attorneys don't just walk into a Federal Court and file a letter. Not unless there is a case.

    Thick as a wall.

To repeat: No emails were classified when sent - and it's only because of a FOIA request the IC community asked the emails in question be upgraded to classified before their release

The State Department objects to Intelligence Community's conclusions, ---> FBI is called in to act as referee between the two of them.

Anyone who says this is a criminal investigation is talking out of their ass.

For some one who thinks their post are so "powerful" and you be so clever, you apparently are unable to even grasp that poster you're taunting is arguing your position.

Yep. He's on *your* side, and you don't even know it.

Anyone that denies it is talking out their ass. The FBI don't investigate machines they investigate who owns them. Oh, and they got 3 thumb drives, not one.

Yet, ten ways from Sunday -- you can't prove it's a criminal case.

All you can say is "ask an attorney."

    Heh.

    - - - Updated - - -

"Key details about the probe remain unclear, such as whether it is tied to a possible criminal case or whether it has expanded beyond an initial security review."

    http://thehill.com/policy/national-security/268688-fbi-confirms-probe-clinton-probe-is-ongoing

Nor can anyone else who is handling the details.

Too bad you're left with diddly and squat.

    Awww.

Awww from his link, from MSDNC.

In a letter disclosed Monday in a federal court filing,

the FBI “has acknowledged generally that it is working on matters related to former Secretary Clinton’s use of a private email server.”

Baker says the FBI has not, however, “publicly acknowledged the specific focus, scope or potential targets of any such proceedings.”

He ends the one-paragraph letter by saying that the FBI cannot say more “without adversely affecting on-going law enforcement efforts.”
    .....snip~

    http://www.msnbc.com/msnbc/fbi-formally-confirms-its-investigation-hillary-clintons-email-server

Again, an Attorney doesn't file a letter in Federal Court unless there is a case. You do know the Court does not start proceedings with a letter, correct. You do at least know that much, Right?

Blind sheep are can be so hilarious.

She released information that's classified. Not one person is debating that. The debate is:

Did she know the information was going to be classified when she released it (Meaning she's absolutely a moron because no smart individual would EVER release ANYTHING that could be considered classified through NISP)
    Or
    Did she intend to.

    That's what's being investigated.

I hope that helped clear up your confusion. Have fun supporting another criminal in office though! It's noted.

The ****ing "case" was a FOIA civil lawsuit filed by the conservative group Judicial Watch vs State Dept., genio.

    http://www.scribd.com/doc/298604923/show-temp

The FBI was forced to respond and confirm an investigation was going on. Something we all knew.

It nowhere says it's a criminal case, genio.

No matter how many times you infer that it does.

And you've still got didlly and squat to confirm it is a criminal case.

I would like to ask Alan Dershowitz one question: Did Hillary have her email server, which DID contain above-top-secret classified information, properly protected and installed in a SCIF, or not? SCIF = Sensitive Compartmented Information Facility: If not, she's broken the law, pure and simple. It's not rocket science, and if she broke this iron-clad security protocol, why isn't she being charged with a crime already?
    http://dailycaller.com/2015/08/14/e...actor-did-not-have-proper-security-clearance/

I haven't found one (ONE) Hillary-lover yet who will respond at all to the issue of Hillary's email server and whether or not it was properly lodged in a SCIF! And, just as bad, I don't understand why people like Rush Limbaugh and Bill O'Reilly aren't raising holy hell about it....

    ICYMI:

    <snip>
"...In addition to the classified email system used in SCIFs, there are personal email accounts.

Prior to 2013, these could be accounts inside the relatively unsecure State Department system or private email accounts. If they are private—running through a commercial or personal server—they have to follow some rules set up in the Federal Register. There are no guards, no red-black procedures, no construction rules, no special rooms, no TEMPEST, no TSCM. And most important:

Until 2013, there was no rule against using them. In fact, the rules specifically allowed for them. Check out the relevant section in the Code of Federal Regulations (36 CFR Chapter XII, Subchapter B, section 1236.22b) for the rules regarding the use of personal email accounts by any State Department official.

To give an idea of how insecure these communications could be, Powell’s personal email is an AOL account, and he used it on a laptop when he communicated with foreign officials and ambassadors, unless the information qualified for a SCIF. ...

So did Powell and the aides to Rice violate rules governing classified information, since the Freedom of Information Act (FOIA) staff has recently determined that some of their years-old personal emails contain top-secret material? No. The rules...."

    Rest at link:

    http://www.newsweek.com/colin-powell-emails-hillary-clinton

I found it most surprising Powell used a grampsy AOL account to conduct his business. AOL!

"To complement the official State Department computer in my office, I installed a laptop computer on a private line. My personal email account on the laptop allowed me direct access to anyone online. I started shooting emails to my principal assistants, to individual ambassadors, and increasingly to my foreign-minister colleagues who like me were trying to bring their ministries into the 186,000-miles-per-second world."

    - Colin Powell, Worked For Me: In Life And Leadership, published 2012.

Personal email account. Private line. A freakin AOHell account!

Of which he deleted a ****ton.

The assertions are NOT that there is TOP SECRET information but merely classified information on Powell's, yet to be confirmed. And Powell and Rice had State Department and Classified email systems. They directed all emails containing classified information be sent through the classified system. Hillary only ONE email address for ALL information, she directed ALL emails be sent to that address which was on her PRIVATE server. Now either she is an idiot and didn't believe as SecState she would not be receiving such information or she acted with reckless disregard for it.

Be that as it made if Powell and Rice did as is being asserted, they dealt recklessly and knowingly outside the secure system to handle classifified information then they should have any security clearances reneged and they shouldn't get them again or be in a position of handling government classified information. Don't you agree?

It is for government agency officials unless the government has access to it and can archive it, ALL OF IT.

And stop with the canard about Congress, Congress is not a federal agency and does not come under those regulations for EMPLOYEES working for the government. They are elected officials and their communications with their constituents are NOT public records. Congress has oversight of the Executive Branch the Executive Branch does not have oversight of the Congress. Learn the difference.

The point being what, they found security breeches and turned it over to the FBI which then investigates to see if a crime has been committed, The FBI stated in court documents it is now a law enforcement investigation of her and her server.

These republican freaknuts are totally clueless. They are just regurgitating what the RW echo-chamber scandal machine tells them to be outraged about.

After so, so, so many tragic disappointments, you'd think they'd learn, but alas...

    - - - Updated - - -

You're going to bust a nut when you find out it's not a criminal case against Hillary, arencha?
