Pre-clinical phase of testing is animal testing.

Pray tell, how would you find human subjects to do phases I, II, and III if a minimum of safety hadn't been previously ensured by animal studies? Did you know that the vast majority of drugs synthesized by drug companies do not pass the animal studies because they are found to be too toxic? Only a tiny minority survive this stage and get to the human trials.

Imagine this dialogue between the researcher (doing the mandatory disclosure of risks) addressing the potential phase I subject:

Researcher - "Sir, we'd like you to take either this drug or a placebo, in order to establish the first bases for an assessment of its safety or lack thereof."

Subject - "Huh, what are the risks?"

Researcher - "Sir, we have absolutely no idea. No clue. It's never being tested on a living being before. It could go all the way from causing nothing, to killing you, with some serious organ damage in-between. The majority of the drugs we try to develop are harmful to humans but maybe this one will be a lucky one. We just don't know since you'll be among the first group of living beings we'll test the drug on. Just sign here, please."

There was no animal testing for these experimental gene therapies. Animal testing takes 1 to 1 1/2 years.
