    As much as I would love to see terrorists tortured, for endless amounts of days...
    We must adhere to the Geneva Convention. Even though these terrorists or suspected terrorists are typically goat ****ing cavemen, we cannot stoop to their level.

    The US servicemen in question were in a foreign nation and had attacked the compound without warning. Everyone in the compound had been killed - men, women, children. The fact if the matter is that "collateral damage = intentional killing of innocents" - has been the rule rather than the exception in Afghanistan.

    The kid was 15 at the time and had just witnessed US soldiers killing everyone else in the compound. On what rational basis does he not have a right to defend himself and how does defending himself against those who he thought were trying to kill him fit in with the definition of "terrorism" ?

    Khadr was foreign also, a Canadian. What was he doing there in the first place?

    His Father took him there.

    A similar question however is - "What is the US doing there ?" cause they sure as heck are not fighting terrorism.

    \In fact Afghanistan has long been a haven for terrorists, which is why the Khards were there. Your point was that the Americans were in a foreign nation, as was Khadr. He killed and blinded two Americans and it was the Americans who saved his life.

    What the Canadian PM did was absolutely sleazy. Had he been honorable he would have given the award to Speers family and the one he blinded. Avoiding this, without apology to the victims, was shameful.

    Why are you sticking your head in the sands of denial. What part of .. "Soldiers had just killed everyone in the compound Khadr was in - including women and children" did you not understand the first go around.

    On what planet is 15 year old not justified in defending himself against these soldiers.

    At minimum this was an action taken in war and that is how it should have been treated.

    The double standard is a Joke and it is the US that is in violation of the Geneva Convention by torturing prisoners of war. Even the guards and people involved in the Khadr case have stated it was a "Kangaroo Court". This was a clown show through and through.

    It is the US that should be paying the bill .. not Canada. Once again we are a joke and a pariah on the world stage - something which is becoming an all to regular occurrence.

    I can see how hard it is to separate two entirely different concepts.

    NOBODY is rewarding a jihadist for being a jihadist.

    the Canadian government is compensating a CITIZEN for the gross neglect he received from them. BY CANADIAN LAW he was the definition of a "child soldier", the incident occured when he was LEGALLY still a child. The rights afforded him by the Charter of Rights and Freedoms was deliberately denied him.
    He was being held by an ALLY completely ignoring such legal nicieties as habeas corpus.

    IOW the government recognized in 20/20 hindsight that its citizens do no LOSE THEIR CONSTITUTIONAL RIGHTS just because they are scumbags (jihadist or otherwise).

    The kid warrants an apology and compensation because he was mistreated by his own government. He isn't being apologized to because his family were a bunch of jihadist scumbags, nor is he being rewarded for protecting himself in a fire fight.

    Course the bulk of the payment will go to his lawyers who have been working pro bono for over a decade.

    THe Bush administration didn't want the prisoners to be treated either as civilian criminals or as prisoners of war so they could deny any and all rights afforded said prisoners depending on their "classification".

    Its only ridiculous to think that this legal ledgerdemaine is anything other than a work around existing laws and treaties. Much like Ivanka and Jerrod got around the nepotism laws. It doesn't make it right, ethical or moral, its just makes it NOT illegal.

    Canada also refuses to honor monetary court judgments against him awarded to victims who sued him.

    The USA should never honor any Canadian court judgment or ruling again against any American.

    Correction "Canada also refuses to honor monetary Kangaroo court Judgments" which are in violation of the "Rule of Law" "International Law" and which lack anything resembling justice or rational thought.

    Absolutely not. The Canadian government ratted him out and then also refused to allow him to be sent home to relatives in Canada, sticking the US with the problem.

    What part of CHILD SOLDIER do you not understand? If somebody is not legally liable as per the laws of the land then they can't be sued by anyone, domestic or foreign.

    Seems some concepts are harder to penetrate than others.

    How about you show me where you can be accused of something, to than be held captive indefinitely without any trial.

    Sounds more you extreme far right got a problem with international law, when it applies against them. Like the International Covenant on Civil and Political Rights: Article 9 recognises the rights to liberty and security of the person. It prohibits arbitrary arrest and detention, requires any deprivation of liberty to be according to law.... Article 10 requires anyone deprived of liberty to be treated with dignity and humanity. This applies not just to prisoners, but also to those detained for immigration purposes or psychiatric care.The right complements the Article 7 prohibition on torture and cruel, inhuman or degrading treatment.

    I know the fascist far right would like to rape the law whenever it pleases them. To than call it all lefty this lefty that when they are confronted with just rather normal, world wide accepted, neutral law.

    Extremists, left or right, seem to find ways to justify denying the rights of others. People do not get that rights are suppose to be for everyone all the time or else they don't exist for anyone including them.

    Since no one has even proven torture that I have seen, and since he was captured during n act of warfare, your point means nothing to me...in any case, the US owes him nothing.

    According to the Geneva Conventions we had three choices after treating his wounds.

    A) Let him go.
    B) Hold him as a prisoner of war.
    C) Treat as a possible murderer, and after a fair trial either sentence him, or if found innocent do options A or B.

    Instead we did option D. Hold him as a enemy combatant ( a nonsense term) and sent a 15 to Gitmo to join "the worse of the worse."

    A child accused of murder after surviving murder of his family during a battle and being wounded. If he was guilty of murder, he did the act were he lived.

    There was good chance he would be found innocent even in a court marshal.

    I suspect someone had a serious hate for the boy and thought the law doesn't matter and diverted him to Gitmo.

    So one could easily make a strong argument that we do owe him a large pile of money.
