Is it legal in most States to protest outside homes? Shouldn't it be illegal everywhere?

Choose to live in the middle of a city? Expect noise. Live in the suburbs? Expect relative peace and quiet.

 

Why? That just sounds boring. And out of tune with things like block parties.

 

We presume lawfulness unless we have good evidence to the contrary. What have you seen that strikes you as unlawful activity?

 

If its not illegal to yell outside a home, it shouldn't be illegal to yell in protest outside a home. If the area has noise ordinances outside homes, then those noise ordinances should be enforced against all noise including protest.

Preventing passage of vehicles and pedestrians. I'm not sure how a protest in a residential area could happen without doing this, unless it was a very small group of people.

 

While I can certainly see the argument for drawing the line there, our commitment to free speech is so robust that generally we draw the line at assault and/or property damage.

I don't protest. I focus on the voting booth, the courtroom and writing my representatives.

Yep yet set foot on there yard at any point it is trespassing further. It is a violation of federal law to do so.

Well last I checked my house has four exterior walls and my yard isn't inside any of them. And again it is illegal to picket the homes of judges under federal law. Do I expect the lawless asses currently running this country to enforce those laws? No.

There is a law that forbids protesting outside of buildings used by Judges where the same actions would be legal if anyone but Judges, juror, witness, or court officer were in, or used the building.

Without threats or actual violence, I do not support criminalization of protests. As Oscar Wilde said, “I may not agree with you, but I will defend to the death your right to make an ass of yourself.”

 

Yes. As a nation we have deep commitment to protecting free speech and of course the test of that is our commitment to protect speech we deeply disagree with.

The answer to speech we disagree with is more speech, not censorship.
