    He was given a special reprieve from deportation by Homeland Security when his wife was in the midst of a high risk pregnancy and he was able to establish the ability to support himself with the requirement he check in every year. Why he isn't a citizen is because he entered illegally. He could have come in near straight away had he been overseas and married a US citizen. Since he did not, he is subject to admission by processing through a US consulate which would require him to go back home and wait 3 to ten years to come back in. Had he left in 2007, he would probably be back by now. He refused to so here we are.

    So the guy spends 19 years here, manages to attain legal Social Security number, work permit and driver’s license a BUSINESS and couldn't be bothered to gain LEGAL citizenship?

    Save me the bleeding heart drama!

    Well there were six amnesties secretly snuck through Congress (kept secret from the American people) from 1994 - 2000 during the Clinton administration.

    Senor Beristain became a "wetback" in 1998 when according to his shyster lawyer illegally crossed the border. That's a crime, not a civil crime but a criminal crime.

    Senor Beristain should have applied for amnesty #3 Section 245(i) Extension Amnesty, 1997: An extension of the rolling amnesty created in 1994 and more than likely qualified for amnesty #7, . LIFE Act Amnesty, 2000: A reinstatement of the rolling Section 245(i) amnesty, an estimated 900,000 illegal aliens.

    How did an illegal alien come into having a legal social security number ???

    Senor Beristain owned a restaurants that likely employed people, likely illegal aliens. Did Senor Beristain break the law and paid his workers cash under the table or did he apply for a "Tax Payers ID Number" that anyone can apply for including foreigners legal and illegal so they pay taxes and make FICA Tax withholdings from employees pay checks ? If you own a business and pay employees you need a Tax Payers ID Number that is issued by the IRS not by the SSA.

    How many additional crimes did Senor Beristain commit between 1998 - 2017 ?

    Senor Beristain claims to be a Trump supporter. At least he didn't admit he voted for Trump or was an undocumented Republican if there is such a thing. (There are Republicans and RINO's, no such thing as an undocumented Republican)

    But how did Senor Beristain support Donald Trump ???

    It's a crime for a foreigner (non- citizen) to participate in our elections. Are there two laws, one for Mexicans or undocumented Democrats and another for Russians ?

    He might still be able to get around it, but it is going to be very expensive for him, but otherwise, pretty much. Some people are successful in this or he could seek a private bill by Congress that applies just to him (for all the good it would do with the current party in charge).

    It was under Trumps changes in immigration policies that allowed him to be deported.

    How does a person with a "legal SS number, and a LEGAL work permit, and a legal Drivers license" get deported ? ICE knew about him, and he was in the process of following the rules WE SET FOR HIM !!!!

    Something doesn't pass the smell test here

    Why do you keep taking Trump's words out of context? You know what he meant when he said they're sending their worst. He also said they send some great hard working people, but that part gets overlooked every time.

    In Obama's own eyes being an Alinskyite, Obama thinks he was successful. As a community organizer in the White House he did manage to agitate, cause trouble, divide America and turn the entire Middle East and North Africa into a complete basket case.

    But as POTUS and CnC he was derelict in his duties as CnC, incompetent as POTUS and failed to uphold the oath of office. A failed administration.

    You can apply, but this was the crux of the amnesty/path to citizenship debate last year, so there is nothing in law that allows that to be granted. To get a green card, you have to apply overseas at our diplomatic mission which requires you to be physically present there but when you leave, you generally will not be allowed back in. If you entered legally and then fell out of status, you can apply for adjustment and stay while that is being processed. This guy entered illegally so he is kind of between a rock and a hard place. If he could prove that being subject to the 10 year reentry penalty since he was here over a year presents a substantial hardship to his family, he could get a waiver to go overseas, apply, and then immediately return to the US, but nothing in the news stories seems to indicate that is likely.

    I mean that for, say, an unskilled Mexican worker, there is practically no way to immigrate here legally.

    He doesn't appear to be qualified for another cancellation of removal nor does he seem qualified to get an extreme hardship waiver to get back in after his consulate interview.

    Yes, I think it's that our immigration policies to legality are F'd up. I've been hearing that story for more than a decade. Though more than 2 admins and both parties.

    Every businessman in Texas used to brag about how Mexicans he had working for them. It was a caste system. Nobody cared if they were illegals or not, they could be underpaid and then you could buy that little ranch on the side, after making enough money....So now Republicans there blame illegals for just about everything, except making them a ton of money. That subject is verboten.

    The article is confusing. Beristain was issued a social security number from ice the same year he was asked to voluntarily deport?
