You can quibble about whether or not it covers artillery or other things, but 'arms' certainly included man portable weapons. Therefore restrictions on man portable weapons are certainly barred.

Looks to me that the court is pretty well balanced with Roberts being the wild card that gave us obamacare. Somehow in the back of my mind, I keep thinking that the lefties are leaning to add a bit more balance with the addition of a handful of additional "impartial" justices. Have I got that correct? Don't bother to answer, the question was rhetorical.

As for "megabombers" I do not know what that is.

why? She presented for a gallstone that migrated to her bile duct. I've got pancreatitis (just across the duct from the gall bladder) and its not confusable with anything else. If they diagnosed her with the stone in the duct, its because they did a scan and can literally see the obstruction and irritation. Its ****ing painful as hell, and you have to not eat or drink anything for a few days to let your system reboot as it were, so it can require hospitalization but its not a respiratory thing you'd confuse with covid. Its blinding pain on the right side radiating through to the back for the gall bladder and on the left same for the pancreas. High and left/right just under where the ribs buttress to become the sternum.
Also: The court is only meeting by phone so she's not going to infect anyone else. It would be a hippa violation to force her to disclose such a diagnostic test result.

    Right?

Remember the riots that broke out when Sotomayor was confirmed? The throngs of crazed right wingers spraying the streets with machine gun fire, and tossing megabombs all over the place?

Yeah, I don't recall that either.

I do seem to recall a mob of unhinged leftists clawing at the doors of the Supreme Court like rabid lunatics, and dressed up in vagina costumes and shrieking like banshees in the gallery when Kavanaugh was confirmed though.

But it's the right wingers that are the crazies, right?

You are 100% correct — I have never disagreed that this is the process.
And I fully hope that Democrats see that the process they have been following does not allow them the... freedom.. to push their ideology in the courts. I look forward to a Democratic house refusing to seat a Republican SCOTUS for half a decade because “thats the process”
Colluding with the older justices to step down so that they can appoint more extreme versions? Thats the process
Getting elected and swapping out justices to lower courts? Thats the process
Adding a half dozen seats? Thats the process

All of this is completely within the purview of the legislative bodies.

Maybe then the right will understand the issues of behaving the way they have — but I doubt it, they will likely double down.

How about background checks before buying a machine pistol or Uzi? Suppose I am profoundly schizophrenic, have a long history of torturing animals, assaulting police officers, and I have convictions to go with them. My own community, including my a used wife and children, family, is terrified.

Most people are. But what if you're mentally I'll, notoriously belligerent and violent, and the militia itself doesn't want you as a member for that exact reason? Are you then able bodied? Do their concerns have weight?

Good points, but there is a limit to how much the electorate will tolerate such machinations. If one gets too cute with process and one will be voted out of office.

Yes, we saw that in 2018 and will likely see it in 2020 — there are temporary repercussions but Americans have a very short memory — the damage is already done however.

    Nope.

If you're that crazy though, you can be adjudicated mentally unfit and your rights taken away when someone takes you into conservatorship. So they can keep you locked up or otherwise permanently supervised so you can't get out to buy a gun.
Torturing animals, assaulting cops etc: Sounds like you should still be in prison, not released. Were terms of your parole that you could never own arms again? No? Guess they'll have to stick with commitment.

Not the answer you were hoping for eh?

I always liked the clawing at the door stunt.

And watching them get paid in the parking lot too.

I had huge gallstones back in early 90's (my late 20's), that was completely misdiagnosed for over a year, before I finally got the correct scan and had my entire gallbladder removed (via emergency surgery).. They gave me the largest gallstone as a take home souvenir, but I lost it in a move. Was the size of a ping pong ball....

That pain was only exceeded when my L4/L5 went bad in a golf swing several years later.... The gallbladder pain was bad, but it would come and go... When you cannot move or get into very few comfortable positions without back pain, that was worse, IMHO.

I survived both surgeries (obviously) and neither issue has bothered me since.

Bottom line, Ruthie will be fine.. already back to work over the phone I hear.

Hang in there, gurl.... 9 more months....

Was certainly a high chance as late as the 2018 midterms.

Now seems to be @ 55% by this oddsmaker.... A lot of races are polling not great for the R candidates..

    https://www.actionnetwork.com/politics/2020-us-senate-election-odds-democrats-republicans

Colorado (Calling that one now), but that evens out with poor Doug Jones losing to either the Football Coach or the Recuser in Alabama

    After that (Last major poll)
    Arizona (4/15 - Kelly +9)
    North Carolina (4/16 - Cunningham +7)
    Maine (3/5 - Gideon +4)
    Iowa (5/4 - Ernst +1)

And don't sleep on popular Gov Bullock in Montana (3/20 - Tie)

Getting to 51-49 isn't out of the question with Trump shackled to them....

Nobody giddy here, but she had damaged this nation tremendously with her crackpot court decisions and disregard for our Constitution.

I am a gun owner and just looking for opinions. But here are my responses (and yes, I was hoping for a better response, so you got me there.)

It sounds line you are saying that if a civil court adjudicates you as incompetent, you lose your gun rights? Correct?

Now, just how unfit do you have to be. Suppose I'm autistic, or suppose I'm lower on the autism spectrum, suppose and endless variety of disorders. What exactly does unfit mean? Is it all in the mind of the judge? A jury? His lawyer will claim that you can't take away freedom of speech with an incompetency determination (and you can't.) Is the second amendment less sacrosanct?
If you think this are wasy calls you are mistaken.

Next, one doesn't remain in prison indefinitely for assaulting cops, so that's a dodge on your part. A copout, if you will. So, suppose a guy has been in prison for 20 years for violently assaulting (with a firearm) a police officer. He's a repat offender. He writes articles from prison daily vowing to "even the score" the day he gets out.

He serves the full 20 years, no parole, and he walks out if prison and directly to a gun store. He wants a nice new AR-15 and 500 rounds. He also wants a 12 gauge sawed off Winchester pump with no plug.

His state legislature says he can't get one. I'm his lawyer and I cite the 2nd amendment.

You're the judge. I await your ruling.

The term malita as used by the writters of the constitution was every able bodied man in the country. It was assumed if you were an able bodied man they you'd be in the malita. There was no joining or not joining.

Therefore you could paraphrase it thus.

Because we want able bodied me ready to defend our country, people can own carry and use arms without interference from the government.
