Not for President (that was the EC) and not for Senators (that was the states). The only Fed elections they could vote in were for the House. STATE elections and FEDERAL elections have never been the same thing.

 

What are you arguing? I dont comprehend this one, the way the original Constitution was set up only white landowners could vote for the EC and states elected senators the way it should be, what's the point of having a Senate?

 

There's plenty the states could do, which is why the Feds don't. Most states and most Americans due to how the population demographics work out have legal weed laws. The Feds could try to start **** but the numbers don't back them up. the people won't cooperate and the states will play the jurisdiction game and not give the Feds money. Same way Sanctuary cities/states have blocked ICE from operating effectively. If the Feds wanted to stop legal weed, they'd have needed to crush the 1st state that legalized it.

 

Nobody could vote for the EC. That was an insider thing with Electors decided by the powers that be. It wasn't until Jefferson demanded a popular vote Primary as the condition to accept the Federalist nomination that Electors had their votes influenced by popular will. And even then, the Electors themselves remain TO THIS DAY an appointed position.
