I stand corrected on part of my assertion. It is a majority of the electors appointed, not of votes cast. If a state fails to deliver their list of electors and their votes to congress by the 6th of January (unlikely) it is certain those electors will not be counted as appointed. I'm correct on the rest. The only way Pelosi or Leahy (assuming they are Speaker (first) and president pro tem (2nd) respectively in the new congress at the time) can become temporary president is first, a president was not chosen by the States of the House from the list of the top three presidential electoral vote getters, and then Pence was not elected VP by the electoral college, and then Harris was somehow deemed unqualified by congress. A new election would never happen.

 

No, not wrong before or again. Congress counts the electoral votes. They do not certify. Their only certification of a sorts can come from an objection and finding that some electoral votes were not cast legally and properly -- a process error.

However, I do have to correct some of my assertions. 1. It is the majority of the appointed (total) electors not the majority of the voles cast that is required for election. 2. The tie breaking list is of the top three not the top five vote getters.

 

You are incorrect. Everyone will be receiving a mail in ballot without their consent. That more than meets the definition of being forced.

 

If it comes down to a House vote, each State votes as a block, and they get ONE vote, no matter how many Reps they have. Montana's one vote will count as much as California's. That will almost certainly lead to Trump being reelected. Your fantasies notwithstanding. But that's been explained to you several times, at least once by me, but you seem to just ignore it. Or more probable, pretend and hope we're wrong. We're not.

 

The States cannot just violate their own rules because of a pandemic. If their law says that mail-in ballots must be postmarked by X date, and received by Y date to count, that's how it is. Even a single vote allowed by authorities outside of those boundaries and the entire State's election and Electors comes into question. At the VERY least, it requires a vote by the State Legislature and a signature by the Governor to change that, and I expect there are Federal Laws in play as well, though full disclosure requires me to concede that much granularity is above even my head.
