    The Supreme Court says if they have suspicion you or someone in the vehicle may have crossed illegally they have the right

    If he had a proper REAL ID law backed ID on him a State ID or Passport Card he would have not been held and he was traveling with people of questionable status. A Birth Certificate is not a proper ID no photo and backed up by other documents to get. I would have ordered him held to until he could prove his legal status with proper identification.

    No it says they have to have a reasonable suspicion. Being Hispanic isn’t a reasonable suspicion.

    There is no requirement to have a passport card, or other state issued ID in the United States. His birth certificate is a valid government issued form of identification. He should have been released within a few hours of producing it. A phone call to the department of health would have verified it. He’s going to win quite a bit of money in his settlement.

    I mean it sort of could be, logically speaking. It's just that racial profiling of that sort is not an allowed justification under the law. (A positive thing)

    Not really. The visitor Visa on file and used almost 60 times would've popped when you ran his name. Its says born in Mexico no current legal status, and hes used it almost 60 times. That means hes getting investigated further ie put in lock up to sit for a bit then interrogated. His story will eventually shake out, and that's why you dont do dumb **** like using false documents in your own name.

    Irrelevant. His US birth certificate takes priority.

    He’s a US citizen. He proved he was a Us citizen. ICE had no authority to detain him one he presented his US birth certificate. He is going to get a YUGE settlement.

    Yes. The investigation consisted of a phone call to the department of health. He should have been released within an hour. He wasn’t. He’s getting a huge settlement because of that.

    He was released after the investigation. Sorry a phone call might not end it, he had a number of documents. In the future don’t commmit crimes like carrying around forged docs. He will be laughed out of the courtroom

    No it wasn’t. They had reasonable belief he was an illegal. They conduct an investigation and released him.

    News false when you carry around forged docs and tell ICE you are Mexican you might get detained.
