Buffalo Police Confiscate Registered Guns Of the Deceased

    This is evidence that registration leads to confiscation....
    These firearms are not the property of the PD.
    If they are concerned that these firearm are a threat to public safety, then they should confirm that they are transferred into the hands of the rightful heirs.

    "Buffalo Police Commissioner Daniel Derrenda said at a press conference last week that the department will be sending people to collect guns that belong to pistol permit holders who had died so “they don’t end up in the wrong hands.” The department will cross reference pistol permit holders with death records and the guns will be collected when possible, he said."

    Sure, but registration doesn't lead to confiscation... The Dems don't want to take guns from the people...that's just paranoid thinking

    What should they do? Lets say the person who inherits the property is a felon. They take them and the person who claims them gets a background check. If he is ok he gets them. Should we just let these guns go to anyone?

    Cops should verify which family member is taking possession of them. If the rightful heirs are felons then I could understand, but they shouldn't just take them, no questions asked.
    Policies like this are exactly why registration is completely off the table by firearm owners.

    Time of death provisions need to be made prior.
    Sadly, once you die. People, including government, will come out of the wood work looking for a freebie.
    My instruction are clear upon my death who gets what.

    A cop can not do that on the scene. He takes them and then that is done at the station house. Cops confiscate guns all the time at crime scenes but let people pick them up if they are not felons

    I believe this right merely needs to be litigated better by gun lovers, in open court. Or, simply get cozier with your Sheriffs.

    This is part of a growing trend. In many areas of the U.S. now, whenever police have any reason to enter into a residence they automatically swoop through the entire house and take any guns. They will even pry open gun safes if they have to. If the records on their remote computer tablet indicate that the owner has another gun, they will continue searching the house until they find it. We are talking about cases of minor domestic disputes here, or the elderly person living in the house died. They will automatically snatch up the guns before the relatives are notified.

    Often times it can be extremely difficult to ever get the guns back. The cost of a lawyer is usually not even worth it.

    It is generally quite easy to get the guns back. Unless you are a felon.

    If they really want to protect the public, they could raid the homes of known criminals and gang members.

    I have experience with it in my town. I used to confiscate them all the time.

    Do you understand the difference between upstate and Metro MYC area and upstate big city area ? There are parts of NY where the people are just as ignorant as some parts of Texas so certain Texans may feel comfortable in certain parts of New York. I would never live in New York City.

    PS there are parts of New York that are so rural and backward that even Amish live there.

    I understand. I have friends from my military days living in the Buffalo area. I hear enough statewide New York news concerning gun rights being stomped on that I won't be moving there in this lifetime. I'm not ruling out a visit.

    Explain the process that is in place, that all police officers everywhere are legally bound by, and cannot substitute it for a differing standard under any circumstances. Explain the legal process in place that prevents police officers from hamstringing and stonewalling innocent individuals.

    It is quite simple. Absent just cause you are entitled to your property back. The police must present just cause for keeping it. If a jurisdiction is doing this improperly on a regular basis I suggest contacting your congressman

    Explain the process of civil asset forfeiture, and how it allows police officers to seize any and all property under the assertion that it was used in connection of a crime, without any need to prove the person it was seized from has done anything wrong.

    Oh that's easy. The police are given wide discretion if there is an issue of public safety. If they feel there is any reason that property could lead to someone being hurt they can temporarily confiscate it. This applies to guns knives swords.....really anything. This has never really been challenged. A loss of your property for a couple of hours has not been deemed to be a deprivation of your rights if public safety is involved.
