What is the big deal about Obamacare being declared unconstitutional?

    The Democrats act as if Barrett's vote to declare Obamacare unconstitutional would be the end of the world for millions.

    Why?

    Assuming the Democrats take control of the presidency and Senate couldn't they simply pass another healthcare program into law that would pass constitutional muster?

    I don't know that the Constitution gives power to government OVER our healthcare. That is a Constitutional decision....not a political one. Whatever, there needs to be a smooth transition and I assume that will take time.

    Yes, I agree. Democrats already know this. They're planning on codifying Roe v Wade as well.

    The issue is the interim period where many people will lose their healthcare, and that assumes Democrats sweep. That's nowhere near certain. The alternative is that Trump wins or the R's keep the Senate. The Democrats have reason for concern.

    Typical of Trump supporters to diminish other people's health and their reliance on the plans they currently have to help them live. It took years to get the ACA through, and like a bunch of kids breaking toys, you don't give a damn as to how it affects people's lives.

    Because it is the only thing guaranteeing those with preexisting conditions can get affordable healthcare coverage. Which is millions of people.

    I'm not aware of the argument, either. Trump doesn't talk about it of course, and the Dems have been focused on talking about what's at stake. I've never heard the constitutional argument against the law, since the individual mandate was struck down.

    One of the arguments is that with the mandate removed...it becomes unconstitutional

    Of course the Republicans removed the mandate

    You people don't know that without the ACA my wife and I will certainly lose our health insurance coverage? It does in fact, "impact" me a great deal.

    Then ALL the more reason why you shouldn't want the Republicans dismantling it. You cannot just willy-nilly throw it out and start all over again. It would take years to start from scratch.

    Ooookay. I have no idea how these things work. Why wouldn't a court direct Congress to rewrite the law rather than hear challenges to its constitutionality? What purpose does this process serve, other than partisan politics?

    ~Democrats have no use or respect for the U.S. Constitution. Obama violated it all the time - and got caught. He admits the Dreamers Act is unconstitutional. Democrats should call themselves the Ping Dynasty . :blankstare:

    ~ I actually lost my health insurance due to ACA. Many others simply could not afford the premiums.

    Congress has changed and there is no instant replacement. A re-write could take years or never happen at all. You can't have bad law on the books while the nation waits for something that might never happen...

    Sure the 5th Circuit Found now that the mandate is not a tax, that it is unconstitutional....which puts into question the entire law. With that said, the Trump DOJ said, we agree that the law can be severed from the rest of the ACA. So the question for the SCOTUS is 1) is the mandate/tax whatever constitutional now? and can it be severed out if it is?

    You have gone this whole time with no insurance? Well honestly that is something you can directly control. Just make more money.
    Thats not the same as someone who has been affording their policy, and is about to be paying for something that is of no use to them if they have preexisting conditions.

    In response to the bolded statement: What IRONY!! That's exactly how many policy holders felt when ACA took place. I lost my policy, had to replace it with a policy that had double premiums, less coverage, and 3x the deductible as the one I lost. So cry me a river, I don't want to hear any gripes now.
