Then is a gun more dangerous than a car? Perhaps it's time for every gun owner and handler to have insurance

"No criminal intent"... a phrase like that just rolls right off the tongue, but that has not been determined yet!

Whether anybody likes it or not, at least one crime has been committed, and very possibly several others as well. Then let charges be brought forth, court cases scheduled, a jury empaneled, and trials conducted to determine what's what. Sound reasonable? It's what we've always known as "American justice", based as it is on jurisprudence tracing its roots all the way back to the Code of Hammurabi over 3,700 years ago....

Or does the fact that Alec Baldwin is a rich, hyperliberal movie star obviate the need for justice in this situation...?

Still avoiding personal responsibility? How would insurance protect the young woman that was killed? How would insurance make the ignorant more educated?

Are you implying that no one should be taught how to drive a car or the rules of the road? All they would need is insurance?

Didn't say any of that. By employing a professional gun enthusiast to ensure safety around guns is accepting personal responsibility. Otherwise why employ one in the first place.

And everyone that has access to a gun should have to be trained on how to use a gun. Do you agree?

I believe that gun owning families train each other. The knowledge gets passed generation to generation.

so there’s one dead woman, one person in the hospital from a shooting and what, Baldwin just gets to say “oops, my bad” and that’s it?
Adults are responsible for their actions. If someone hands you a gun and you point it at someone and pull the trigger you are responsible for what happens. If you don’t understand the workings and rules of firearm operation then the “Adult” shouldn’t handle it? This includes Baldwin and the woman who was responsible for making sure it was not “hot”.

I am reading through this thread, and a parallel comes to mind. All I see is a bunch of people with ropes and white robes. New Mexico law will sort out what happens here, and they will not decide that based on how much they like or dislike Mr. Baldwin. It's funny though, I never knew all the stuff people are saying about him, or his political views before this thread. And that is because I don't care and don't want to know to be honest.

What's funny though is I bet some of the people calling for Mr. Baldwin's head leave guns around loaded (because you might need to use it...) and when they carry they have a round chambered. When I carry my Glock I do not chamber a round and when it is not on me it is in a safe unloaded, same with my AR.

The safety of props used in movies is not the actor's responsibility. If that were the case, then where does it end? The car they drive in a scene, the furniture they use for a scene? And yes, I understand, the gun is real, but it is used in a movie so it is a prop.

Yes, this is unfortunate, and absolutely could have been avoided. But in my mind the negligence lies with either the armorer or the asst director. Those are the two people who handled the gun and said it was safe for use. But again, in the end the law will decide.

    Back to basics:

    Who held the revolver?
Who pulled the trigger of the revolver?
Who actually killed (KILLED) Halyna Hutchins?

Therefore, who should be at the top of the list of any and all who should be charged in this situation?

Hint: you don't have to go all the way back over 3,000 years to the Code of Hammurabi to figure this out!

They had firearms in ancient Babylonia?

What "crime" did Alec Baldwin commit?

Thats not how the law works. The armorer may have some responsibility but the person handling a firearm always has the ultimate responsibility.

True, the law does and in this case the shooter shoulders the ultimate responsibility. Pleading ignorance will not win in court.

Really? Elaborate, please. And it'd better not reflect your actual thoughts which are "Alec Baldwin is an icky liberal, therefore he's a baddie criminal!"

I wouldn’t wish what happened to Baldwin on my worst enemy so quit trying to make it political. Are you aware what prosecutors do?

Baldwin is making a big mistake retweeting and tweeting after the incident. He is handing the investigation evidence. He retweeted an article saying the assistant director did not check the firearm before handing it to him which implies Baldwin didn’t either. That will be used against him. How firearms are handled is always the responsibility of who is handling it. Other actors are speaking out that the way they were handled on that set was wrong and they always check the firearm themselves before rehearsal or a shoot and that they have never heard the term ‘cold’ on a set.

Since Baldwin is also a producer of Rust he has extra liability.

Naw, Nemmi, but people killed other people in ancient Babylonia often enough that old Hammurabi threw together some strict laws concerning those matters. Duzzat really come as a SURPRISE to you...? :icon_picknose:

And nobody has yet proven (PROVEN) that Alec Baldwin committed a "crime", per se... but, nevertheless,

    Alec Baldwin held the revolver...
Alec Baldwin pulled the trigger of the revolver...
Alec Baldwin actually killed (KILLED) Halyna Hutchins!

Can we agree on just that much?

The jury is still out on that one. Actually the jury hasn't been selected because charges have not been filed.

Maybe you'll just have to wait and see as opposed to declaring the outcome.

Of course. The investigation is not complete but stating the law as it applies here is not determining the outcome nor will it determine if justice actually will be the outcome. Justice often isn’t the result.

If you want to go down this road, both of you guys might want to refresh your understanding of the Second Amendment to the U. S. Constitution:

"A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed."

It is to be hoped that you remember the overpowering gravity of the use of the word, "shall" in Federal Government law, and, that you also know what the word, "infringed" means....

    Then state the law.

I suspect the legal outcome will be same as Bandon Lee's case, where the DA determined negligence was involved but they did not press charges since it was an accident with no criminal intent.
