Citizen Trump may have broken a law that President Trump made a felony

    This is textbook irony. Because of Clinton, Trump signed into law regarding classified documents, a change in the law that was a misdemeanor with a one year sentence to one with a five year sentence, which makes it a felony.

    If Trump is found to have violated federal law in removing and retaining classified documents without authorization, he could be convicted of a felony punishable by five years in prison. And that conviction would be a felony carrying that punishment because of a law signed by President Donald Trump.

    What became law was S. 139. It had been introduced by Sen. Orrin G. Hatch (R-Utah) as the Rapid DNA Act of 2017. But sometimes Congress hollows out existing legislation and replaces it entirely with other legislation to move the process forward more quickly. So S. 139 was replaced with H.R. 4478, which extended Section 702 for another five years.

    It also had a stipulation editing 18 U.S. Code §1924. It originally read:


    With Trump’s signing S. 139 into law, that became: “ … shall be fined under this title or imprisoned for not more than five years, or both.” And with that, it became a felony.

    You can see how Trump absconding with classified material to Mar-a-Lago would facially violate the law as articulated. So Trump’s allies have already been offering a rationalization: He had declassified everything he took to Mar-a-Lago

    We shall see if there is any evidence of his alleged declassifying or if this is classic Trump backpedaling. If that were true, I doubt Garland and the federal magistrate would have signed off on the warrant.

    What I read is that the FBI were already aware of the docs Trump had, already aware they were declassified, and simply wanted him to put a lock on the box they were in. Or, at least, that was the justification used to obtain the warrant.

    IF they are determined to be TS/SCI docs, Trump cannot declassify them.

    It is called “kid gloves” and take it fro me if that were ASIO and our ex Prime Minister FIRST he would be treated to at least 15 minutes I’d dressing down/ being sworn at in the most creatively uncivil manner humans could invent and THEN they would have physically kicked his arse around the continent and back

    Nuclear material cannot be declassified until the 25 year mark, period, per the law and EO. I know his allies are stating this, but under the law, only the issuing agency can declassify the document. Trump is not a dictator here and must follow the law while in office, especially with declassification is concerned. This is usually done by the Executive Order of the President that follows the Executuve order and law that is currently in place.

    These documents will have to contain the letters, "RD," "FRD," or "TFNI" with authorized persons from the DOE or DoD depending on which letters on this document.

    But somehow, these documents will not show that and the warrant would prove that the documents were classified at the time the search warrant was issued.

    Your side is going to lose big on this in the long run, especially legally.

    Maybe he should have put a lock on it and documented such? Even a quick phone pic would have worked.
    Let's see if people learn from example. I know for a fact people don't. Which is why prohibition is such a failure.

    yes, it's ironic that this was done under the guise that Hillary got away with murder, so, I guess Mr. Projection and Irony, thought he would test his own spawn.
    No need, if it was declassified (there is a process and also documentation but the supposed classification may also be that they can't be declassified) the DOJ and the Judge could not get a warrant unless Trump and his "lawyers" are as incompetent as most know they were.
