Trump is trying to make this a contract dispute? Oh really? Usually, Trump should have said, "this is off the record" and Woodward would be legally bound not to report this. But to suggest one book, and Woodward has mulitiple avenues of whether that is too little or not, is not a valid contract, even verbally, especially if Woodward agrees to such a condition under the UPC and common laws.
Trump suing for "breech of contract" that is purely verbal in whatever location they were in, say Washington DC, is highly dubious and extremely circumstantial.
I read the complaint. An oral agreement is valid if and only if an offer is made, acceptance is required, and an agreement is done through some sort of gesture, such as a handshake or something similar. However, if the tapes show that Woodward never accepted that offer, then Trump's lawsuit is null and void. And with oral agreements, it is circumstantial at best and no one is saying, not even the compliant itself, that Woodward agreed to this specifically. Again, Trump should have said, with any information that he did not want to disclose is use "this is off the record" and Bob Woodward, by standard Journalism ethics wouldbe bound by that statement. But Trump didn't do that. https://www.legalzoom.com/articles/oral-contracts-do-they-carry-any-weight
If you read the complaint, it sounds like Woodward did plenty wrong, (copyright violations) though we'll have to wait and see if the court where the lawsuit was filed agrees.
I do not think Trump had a copyright claim to the President's words about the job the President was doing - Woodward may have copyright to the book, but his quotes are open source, the words of a sitting President can not be copyrighted
Its not coincidental that the filing was in Pensacola Fl.........someone was searching for a friendly court. I would bet that the appeals courts in that district are jammed with Trump appointees
This is a great interview Woodward just did on Jan.16th. 23 mins. 'Bob Woodward on His Calls with Trump' "Bob Woodward has been writing about the White House for more than fifty years, going toe to toe with nearly every President after Richard Nixon. Woodward is every inch the reporter, not one to editorialize. But, during his interviews with Donald Trump at the time of the COVID-19 crisis, Woodward found himself shouting at the President—explaining how to make a decision, and trying to browbeat him into listening to public-health experts. Woodward has released audio recordings of some of their interviews in a new audiobook called “The Trump Tapes,” which documents details of Trump’s state of mind, and also of Woodward’s process and craft. Despite having written critically of Trump in 2018, Woodward found his access unprecedented. “I could call him anytime, [and] he would call me,” Woodward tells David Remnick. His wife, Elsa Walsh, “used to joke [that] there’s three of us in the marriage.” audio: https://www.wnyc.org/story/bob-woodward-his-calls-trump/
Maybe 45 will claim that the words that were used without his knowledge were all “classified”? Yeah, that’s the ticket!
You can read it here. https://www.msn.com/en-us/news/poli...suit-against-bob-woodward-in-full/ar-AA16VKZQ
Trump didn't have to approve the release. As long as he consented to the recording then Woodward is free to do with them what he wants.
Is there a contract for the book between Trump and Woodward? 'Bob Woodward says Trump Tapes reveal 'evasions,' 'denials' — and outright lies' 'Veteran journalist releases audiobook of his interviews with the former U.S. president' Woodward: 'He did say that these interviews were all on the record, taped with his knowledge. If you listen to him, you'll hear many times he says, "Now, you've got your recorder on, don't you?". We agreed this would all be public. I don't believe that a sitting president can talk with the reporter any other way than on the record.' https://www.cbc.ca/radio/asithappens/bob-woodward-trump-tapes-1.6638511
I do not believe that they are troubled. Have you seen any indication? I also do not think they will counter sue. It would make them lower themselves to Trump's level. Laughing when it gets dismissed will be enough.
If there was any chance that they might have to pay it, then I'm sure they would be concerned. Since there is exactly 0% chance of Trump winning then I'm sure they are not concerned.
What legal cases are you basing the 0% chance on. There's been some cases where copyright has been determined a joint ownership matter. In this case you have an interviewer and an interviewee that might share that ownership. Trump is saying he explicitly told Woodward that his audio interview was for a book alone. Not itself for publication. If there's any proof of that Trump might (a >0% chance).
