FBI recovered 11 sets of classified documents in Trump search: report

    Per his standing orders according to Trump, anything that left the white house was declassified the moment it left. So why is the lawyer signing a statement that all classified material had been returned at Mar-a-lago when all documents were declassified? Were classified or de-classified materials returned?

    this makes sense.
    Did this statement specifically say there was ever classified documents at Mar-A-Lago? When something is returned to the archive are you just assuming it was in Mar-A-Lago or is there evidence to show that it was?

    Does the lawyers statements say that records returned to the archive were at Mar-A-Lago?

    Whether or not Trump declassified it isn't the biggest issue. Where in the constitution or federal law does it stipulate a president can keep government documents after leaving office?

    The president can declassify documents but at law there's apparently procedure that have to be followed. So first question is did he follow procedure?

    Secondly Section 793(d) of the Espionage Act states “Whoever, lawfully having possession of…any document…relating to the national defense which information the possessor has reason to believe could be used to the injury of the United States or to the advantage of any foreign nation…willfully retains the same and fails to deliver it on demand to the officer or employee of the United States entitled to receive it” is guilty.'

    The thing is declassifying a document covered by that act doesn't necessarily protect a person found in possession of documents that fall within it's ambit.

    Several people have asked in this and other threads - why did he have the documents in the first place? Why did he need them?

    And a few people speculated an answer to those questions. The fact is no one can look inside his mind to answer that question. The questions that should be asked are: Did he personally point to any classified documents and order them packed up? (Possibly proving intent). Did he declassify the documents prior to their removal? (Leading to a legal question of his authority to do so). Was his legal team negotiating with the parties seeking them? (Also going to the question of intent). All these questions will have to be addressed in court and if the same standard was given to him that was given to others, then the reasonable question would be; Why not? (If it isn’t).

    You do realize, that the second he made the determination that everything collected was declassified by him, do you not? So regardless, there were no classified documents taken. You do understand that, right?

    A president or former president are not you or me. How often did you take your work home with you? In this case a president's work has much to do with classified information so should a president declassify information every time he takes it home with him and then reclassify it when he brings it back to work? And what, some civil servant needs to okay a president's declassifying information? A president doesn't go through a background check to get a clearance. There is an understandable reason why they don't. This whole thing is pure nonsense. The bigger question is why those suspected documents weren't removed back in June when the files were seen? If they took some files then they could have taken them all as well before they left. What game is the DOJ playing? I'm guessing that is what most Americans are asking themselves?

    He took possession of the files while he was still president. If he says be believed they were not classified then it is up to the DOJ to prove otherwise. Only a confession from Trump will do that. Even the labels on the files can easily be disputed by claiming a civil servant clerk forgot to remove them. End of story.

    What was used to gain access to the files in June and several of the files were removed from Trump's property? Also wasn't the FBI wearing body camera's?

    Was the lawyer referring to documents Trump didn't take home with him but returned to the NA? Those documents would not need to be declassified. President's regularly take their work home with them which includes lots of classified information. For this reason a president is trusted in the handling of classified information and they do not have to jump through hoops every time they need to bring the documents home with them.

    Another point that is being overlooked (or ignored) is; Who exactly packed the boxes? Is it possible that someone within Trump's circle was part of the swamp having the intent of planting incriminating evidence? Planting evidence is not something new.

    I won't go there but we certainly know Trump didn't pack his own boxes. But Trump was still president when the boxes left the WH so Trump still had the authority to declassify documents that were leaving the WH to go to his home.

    Maybe, maybe not. But body cameras are not going to save your side with this.

    In June, it was a subpoena in which some files were discovered, but it appears not all. Reports are that the attorneys signed on behalf of their client that this was all. Personally, I think someone gave detailed info or enough detailed info on those boxes to obtain the probable cause for the search warrant, which the GOP desperately wants the affidavit for. That will have the name or names of the FBI agent, probably a supervisory agent in charge, or SAC, and enough detail as to who the person or persons who told on the FPOTUS. The rest such as body cameras, locks, and who "packed those boxes" are just darts on the wall to see what sticks.

    I lost count of how many boxes were stored at his residence. Is it reasonable to think that Trump sat there, as they were being packed, pointing to each document and declaring them declassified? Is it reasonable to think that he personally chose who could pack them? These questions go to the intent argument.

    Before the FBI raided Mar A Lago, probably interns and low-level staff members at the WH under the instructions of the WH Chief of Staff, Trump, or other senior advisors to the President before he left office.

    It usually takes anywhere from two weeks to a month for all this stuff that the POTUS has to be packed up and to prepare the WH for the next occupant as the President. There is a budget for this, but not for the First lady and the rest of the family, if minors are involved. This is part of the President transition process.

    Well duh, the GSA packs, organizes, documents and sends an inventory to the intel teams. Everyone has known every document in those boxes since he left.

    No, Trump didn't sit there. More than like, he gave general instructions to the staff and so forth.

    I'm sure a jury will want to see if the search was done by the book. Isn't that what the public is calling for from the police departments? If they are unable to produce proof the search was done by the book if could all be thrown out for technical reasons. But since a president has the final say whether a document is classified or not this and a president says he believes they are not classified it is over unless Trump confesses he knew they were not declassified. But this is all a misdirection by the DOJ and LSM because what the DOJ really wants if proof Trump was directly involved with leading the J6 riot. All this misdirection will be dropped if they find something or they don't. You can bet if nothing is found there will be lots of repercussions against the DOJ, and the FBI. And the Democrats worst fears of another Trump presidency will probably take place.

    Having spend many years in Civil Service I don't put a lot of faith in the work government employees do. I'm sure many mistakes were made like not removing the labels from the files before boxing them.

    Except in this case Trump didn't believe he would be leaving the WH. The packing, therefore, was a last minute thing. If you recall, Comey took advantage of the "chaotic" nature of the new administration to go after Flynn. Was this another opportunity for the FBI?

    He was also known to ask if he could keep something. That suggests only his naivety concerning his own authority. Another point towards the intent argument.
