FBI recovered 11 sets of classified documents in Trump search: report

    Even if Trump did personally oversee the packing process he was still the president and the final authority in determining the classification of information. I really doubt a president is required to go through a paper trail to make to declassify information. If a president can surpass congress via the War Power's Act he certainly is trusted with being able to unilaterally determine the classification of information.

    If a president is the final authority on the declassifying of all information why does he need to sneak documents out of the WH? But the raid wasn't about classified documents it's about finding evidence Trump was directly involved with the J6 riot.

    He didn't sneak anything out. The Archivist witnessed on TV boxes being carried to the departing helicopter and raised the alarms about it.

    No as president he wouldn't have had to sneak anything out. But let's stop focusing on the documents because that is not what the search was really about. This is the LSM trying to misdirect everyone from what the search was really all about. The DOJ wants proof Trump was directly involved in the J6 riot. The elections in November are near and the J6 committee needs a huge win otherwise it is over for Pelosi and her minions. And then comes 2024. The Washington rats are scared of Trump.

    Except you are forgetting one important detail, the NARA. Al the former presidents, have complied with the act since the act took effect in 1978. this included Reagan, Bush Sr, Clinton, Bush Jr, and Obama. The only exception is Trump. No ifs, and's, or butt's. The only thing you are doing right now is throwing mud at the wall to see what sticks, and so far, it is not sticking, not even a little.

    Yes he is the executive, but even executives have to follow the rules and laws, don't they? Or are you insinuating that they are an absolute monarch now? But once he leaves office he is no longer the executive. He cannot claim executive privledge post facto nor can he simply state now that they are all declassified either. That will not hold up in a court of law if charges are brought and he is on trial.

    AS for declassification, Executive Order 13526 lays out precisely what to do, how to do, and when to do declassification. It is not as simple as him saying it or anything else, especially when it involves top secret secretive compartmentalized information. This is the highest top secret sort of thing where information is extremely sensitive that it could weaken our national security if that information was made public too son.

    Apparently, you never read the Mueller Report in detail. I have provided links to the Mueller Report. Some things in the Steele Dossier were verified and some were not. However, my thought are that the report fell short because Mueller never deposed in a deposition on those cases there and how much he knew, if any. But from what the report read, it never cleared Trump either. The report stated that quite clearly.

    So instead of regurgitating talking points from any media outlet, try going to the source for once.

    I already posted how you couched your statement.

    Out of 35 boxes only 11 sets of alleged marked classified documents which he claims were declassified before he left office.

    You do know none of the laws cited in the search warrant have to do specifically with classified information, merely government documents. Why is that?

    The Criminal Codes in the Search Warrant Don’t Care About Classification Status
    Specifically, the search warrant specified that the “property to be seized” included “all physical documents and records constituting evidence, contraband, fruits of crime, or other items illegally possessed in violation of 18 U.S.C. §§ 793, 2017, or 1591.” Material need not be classified to fall within any of those criminal code provisions.

    Rather, for instance, under Section 793, also called the Espionage Act, it is a crime for a person with “unauthorized possession of” documents or information “relating to the national defense,” that the possessor “has reason to believe could be used to the injury of the United States or to the advantage of any foreign nation,” to “willfully retain[] the same and fail[] to deliver it to the officer or employee of the United States entitled to receive it.” Documents and information could be “related to the national defense” without being “classified,” and an intelligence community desperate to convict Trump of something could easily frame the material as providing an “advantage” to a foreign nation. Further, given the Presidential Records Act, Trump arguably has “unauthorized possession” of the material, although if it is a copy the issue is dicier.

    The second statute cited, Section 2017, criminalizes the removal, destruction, or concealing of government records, which would include presidential papers, and again that provision of the criminal code does not require the documents to be classified. And the third statute, Section 1591, addresses “Obstruction of Justice,” but before moving there, the warrant’s reference to Section 2017, read in light of the leakers’ comments, proves informative to understand the latest targeting of Trump.

    Newsweek’s “exclusive” report on the supposed confidential human source that prompted the search of Mar-a-Lago claimed that “the road to the raid began a year-and-a-half ago, when in the transition from the Trump administration to that of President Joe Biden, there were immediate questions raised by the National Archives and Records Administration (NARA) as to whether the presidential records turned over to the federal agency for historical preservation were complete or not.”

    The whole "they were CLASSIFIED" is a ruse for the FBI to just go in and get EVERYTHING because they could not present an probable cause to do with Jan 6.

    And every President has taken their personal effects with them and I have no reason to believe it was any less than Trump took or that there were similar discussions over what went to the archives and what didn't and it didn't required an FBI pre-dawn raid.

    That order does not apply to the President, his power and authority over classified information is a plenary constitutional authority and cannot be subverted by legislation or the EO of a President. You'd have to pass an amendment.

    Oh Steele reported the weather accurately on certain days? Nothing to do with Russian collusion was proven or advanced. It was a sham and even the Russian who supplied the info has admitted it. Mueller was a joke and under oath when asked about Fusion GPS he stated he had never heard of them. That is how little he knew.

    Yes did the FBI place an informant into the house of a former President?

    And no they don't take an eraser to the document in his hand and erase it off. It appears one of the sets are the personal communications between Trump and Kim Jung-un. Trump believes they are his personal records, the NARA believes they are a presidential record. That is something to be negotiated NOT some FBI raid to get them.

    There is no reporting that anything classified was active classified information. Why did they take their time about it, two months between the warrant being issued and being served, if there was this imminent threat to our national security? And they did not search under the Esponage Act but other laws that do not stipulate classified information and went in and grabbed every document from his presidency.

    This isn't about classified information, that is a ruse. This is about Jan 6 and anything else they can find to try and prevent another Trump presidency.

    Clinton had the intent to store classified information in real time on her unprotected server. She had intent to keep that secret and intent to not turn over 30,000 emails to the NARA. She even had the intent to destroy them. Sandy Berger had the intent to steal classified information by stuffing it down his pants and his socks and leaving it in an unsecured place and going back to retrieve it. The GSA packed and shipped docs to Mira a Lago as Trump left office. The docs have been stored with NARA and FBI access being granted as requested.

    Clinton refused to turn over her docs and told the FBI that her personal attorney would go through them and turn over what HE believed were presidential records, then she tried to destroy the rest. She was never served a search warrant, she was never interviewed by the FBI, she was never prosectued for lying to Congress about her server being approved. She was never prosecuted for the destruction of records.

    Remember the standard is that prosecutors do not prosecute these cases so what is going on here and now.

    Because former Presidents are often consulted with by government officials. Former presidents write memoires and have libraries which house such documents. It appears one set of those 11 sets are the personal letters between Trump and Kim Jung-un which he would want for his personal memoires and the library and could make the case they are his personal records not presidential records.

    You don't even know what all the documents are yet your are peeved about it. Why do you even think this would be active intelligence?

    Berger is the best comparison to trump, and he was convicted of a crime….
