TheDC: As a lawyer, do you think that there’s anything illegal about what Trump said during his phone call with Ukrainian President Zelensky? If he was your client, how do you think you would feel?

Dershowitz: Well I would have wished he didn’t say it. On the other hand I don’t think there’s anything criminal. I think, to find a crime, you have to first find the statute that was violated and it was a conversation about general corruption in the Ukraine which is plentiful. I know I had cases in the Ukraine. I represented the former president of the Ukraine. And then he asked for a personal favor. Is it the right thing to do? That’s a very different question from his criminal.


And so I don’t see any possible criminal conduct. [There are] those who say that being given dirt by a political opponent is a violation of the election laws. That can’t be the case. The First Amendment trumps the election laws. And under the First Amendment anybody is entitled to use and obtain information from whatever source the election laws relate obviously to financial contributions not contributions of knowledge or information. So I don’t think there’s anything there.

And unless there was some kind of an extortion and I don’t think that the president of Ukraine would ever say he was extorted, he was not critical of what happened. I just don’t see a criminal violation here.

And Dershy seems to be talking about exclusively the release of the phone call notes (I refuse to call that a transcript)... no mention of the complaint, so I'll assume this was before....

I'll admit the call without any other knowledge about the situation is probably not criminal....

But it's still impeachable.... Sucks to you, doesn't it??

And I doubt he verified everything in the 9 pages in 2 weeks... he just judged it credible (seems to be) and urgent (doesn't seem so much now since Ukraine eventually got their money, but before that, it was SUPER urgent...for Ukraine)

That's the part of the story that Trump really cannot explain away... the withholding of the money with some general issue with corruption... that story sucked from day 1 and it sucks HUGE now...

An "Impeachable Offense" does NOT have to be a per se Statutory Crime.

Also, it is Self-Evident that MANY Things that would constitute an "Abuse of Power" are NOT per se Statutory Crimes.

In other words, in terms of an Impeachable Offense, Dersh's Drivel Means NOTHING.

 

The MSM and their bovine followers will go on for weeks about Trump exaggerating crowd size but will ignore altogether Hillary Clinton lying in front of Congress. This inability to recognize or differentiate is not healthy on an individual level or, ultimately, good for the country and its political process.

 

If Hillary lied to congress then trumps DOJ would charge her.

This entire " do us a favor " is maybe not criminal. But impeachment is a political decision which does not require thete to have been a crime committed.

Having said that I would not with what we have go with impeachment, yet. I have already spoken out against impeachment.
