If the classified information was intentionally or illegally retrieved H.Clinton would have been charged with a crime. The fact that she was not proves that she did not intentionally or illegally retrieve it .

To prove an intentional act one has to prove that she was aware that it was classified and intentionally placed it in jeopardy. Did she know that the server was not secure and did it it intentionally ?

 

There is no way that the Secretary of State was given access to classified information without the full awareness and training that comes along with an SSBI level security clearance. No.

There is no way to log into a classified network without going through a system that reminds you that what you're accessing is classified, and the penalties for removing that information.

There is no way to get classified information off of a SCIF or SIPR connection without manually, illegally, and intentionally doing so.

Occam's razor: She knew what she was doing because she must as the SoS, and because the system is designed at each step to tell you what you are doing. Inadvertantly copying information from classified to unclassified is impossible without intentional steps to do so. Therefore we know she committed the crime.

The only question is why was she not prosecuted for it.
