Georgia judge denies bid to revoke Trump co-defendant Harrison Floyd's bond over social media posts

    Fani Willis had a rough day in court today. She was pretty mad at multiple times during the hearing. The crux of the story is Harrison Floyd made comments on Twitter that Fani Willis claims were a violation of his bond, and she wanted his bond revoked. She demanded Floyd be sent today to her poorly run jail that just so happens to be one of the most poorly run jails in America where people keep getting killed.

    She called two witnesses. The first witness was her assistant who said he couldn't speak to the intent of Floyd's posts. Fani had to step in a couple times and save him after being visibly upset with some of his answers. Her second witness was asked if he knew what case he was there to discuss when he took the stand, and he said he didn't. To say she didn't get off to a good start would be an understatement.

    When the defense got their turn they basically said Fani was misrepresenting the bond requirements and even claimed her office committed a felony by having a secretly recorded phone call of his colleague in Maryland despite Maryland being a two-party consent state. Wowza. The social media post was about Jenna Ellis and apparently Jenna claimed she didn't even know about his post until a couple of days later, coincidentally when Fani opened this up. The defense all but accused her of manufacturing a statement from Ellis by soliciting her statement that she felt intimidated. He basically said she has a million followers and likely never would have known about his tweet since it wasn't a direct message and likened it to a hypothetical of his client yelling in the Atlanta Falcons stadium that she should return the money donated for her defense to fight the charges. The defense also said he didn't know who the potential witnesses were going to be because Fani still hadn't given him a witness list, and the discovery was voluminous and unorganized. The judge pushed back on that based on some of these witnesses taking deals with Fani and he could be sitting next to some of them at trial. The defense responded by saying that these witnesses had no material facts relevant to his client and that he doubts it will get that far implying Fani has no case and this won't get that far. The defense attorney had no chill.

    Ultimately, the judge came to the conclusion even when defendants are out on bond they're generally allowed to criticize the merits of the case and he didn't find anything in the bond order that limits that general criticism. In regard to claims of intimidation he found that Floyd did not post personal info, did not directly message her, did not suggest an action, etc. The judge said his reading of the Twitter posts were just of a defendant who wanted to defend his case in a "very public way." He even said that in regards to public figures they endure a lot worse than what was part of his tweets. The judge suggested they modify the bond order going forward and to adjust them for the nuances of social media. The original order said he was not to communicate "with" certain people and not that he couldn't communicate "about" certain people which is common when you don't want a defendant to collude with witnesses on testimony. The judge said that while on bond his rights can be curtailed, but he still has certain speech rights. He suggested changes to the order for specific people and that they can't have it for everyone potentially involved. Fani was pissed. Floyd had a sh**-eating grin on his face. Rough day for the prosecution.

    Normally these types of hearings aren't interesting, but this one definitely was. It will also be curious to see if they'll press charges against whoever it was on Fani's team that illegally recorded them. Presumably a lot of people in her office were aware they were making these recordings. Smells like a criminal enterprise to me.

    During Sydney Powell's interview, she says Trump "believed he won". That comment does a lot of damage to Willis' case. That's why she's freaked out.

    IOW, Trump and his acolytes continue to press the boundaries of what does and does not constitute comments meant to intimidate potential witnesses against them.
    The ruling was not really surprising coming from a former VP of his school's ultra conservative Federalist Society.

    The argument that Willis has made is that Trump knew he had lost. That little fact has been the bases for every claim that he committed a crime.

    Sydney Powell, a witness for the prosecution testified under oath that Trump believed he won the election.

    That weakens Willis' case. She can't say in court that he knew he'd lost without calling her own witness a liar.

    First things first.

    Prove it. I can't find any link to confirm it.

    She also said the election software was created in Venezuela at the direction of Hugo Chavez and she would “blow up” Georgia” with a “biblical” election lawsuit. She will be able to testify with first hand knowledge about various aspects of Trump's conspiracy to overturn the election. If she testified as you claim her belief will be refuted by multiple witnesses. You're foundering.

    Yes the entire multiple persecutions of Trump is a diversion for the deep stuff the Dems are in with Biden as President and Trump, and everyone else for that matter, beating him in the polls. They have to get Trump into prison to keep Biden in office. Welcome to your new world.

    And other people told him the election was stolen, he won, and that he had a legitimate claim. The topic was a matter of what he believed, not what individual people told him. He's allowed to disagree with people and contest an election he felt was improperly run. Fani Willis is trying to prove Trump knew he lost and was trying to steal it despite knowing better. Yet, she has people swearing to the fact that Trump believed he won the Georgia election. That hurts her case. This is the entire reason alternate electors exist and why they have procedures to contest elections.
