Upgraded from second to first degree murder.

Good, I hope they throw the book at him.

I thought 1st degree murder had to be premeditated?

That's a good question. I was under the impression that even a random killing could be considered first degree murder.

here is some definitions on 1st degree...

First degree murder is any murder that is willful and premeditated. Felony murder is typically first degree.[5][6]
    http://en.wikipedia.org/wiki/Murder_(United_States_law)

    here is felony murder.....

The rule of felony murder is a legal doctrine in some common law jurisdictions that broadens the crime of murder in two ways. First, when an offender kills accidentally or without specific intent to kill in the commission of a felony, the offender can be charged with murder. Second, it makes any participant in such a felony criminally liable for any deaths that occur during or in furtherance of that felony. While there is debate about the original scope of the rule, modern interpretations typically require that the felony be an inherently dangerous one, or one committed in an obviously dangerous manner. For this reason, the felony murder rule is often justified by its supporters as a means of deterring dangerous felonies.

so im guessing its Felony murder which is charged under first degree???

Purposefully shooting into another vehicle can be considered pre-meditated.

At least according to the courts.

Depends how it actually went down.

Reports I've seen say that the teens were backing away when Dunn opened fire.

I would say that escalates things, if they were attempting to flee or get away from Dunn.

This guy had claimed that a gun barrel was pointed at him from inside the car. The police found no gun. This guy has a big job ahead of him proving he had reason to open fire.

All I can say is that this is the wrong time for Dunn & Zimmerman to be facing (senastionalized) handgun-murder prosecutions ...

Looks like they have the PC to charge him unlike Zimmerman. If the prosecutor can prove 1st degree murder with evidence, then fry his arse.

From the information we have, Zimm has a far better chance of being found innocent.

Yeah I'm curious as to why they aren't charging her with something.

She didn't report it, didn't call the cops, nothing.

Seems to me that's an accomplice role.

Great ... hunt-down a hoodie-wearing *coon* or *punk*, start a fight with 'em then shoot 'em to death then declare it was *Gods Plan* ... then be caged-up with a GPS and Bulletproof vest while awaiting prosecution ...

Strange how some people find the *meaning of life*

perhaps because of the story her husband told her. i mean she didnt witness the event, she came out after it already had happened. and knowing women she probably freaked and believed the first thing her husband said.

she didnt have anything to do with the argument or anything that lead up to her husband killing that teen. i dont think she should be held responsible.

now had she seen the whole thing and heard everything, that would be a different story.

    This is true.

I just couldn't see not reporting it. It just seems to crazy a situation to not call the cops.

Geddom, even if a person didn't see/hear what happened, when you KNOW your hunny shot and killed someone, you do not take off w/him, leaving the crime scene, even if your hunny tells you 'he started it'.....

Someone is dead and questions need to be answered and you're w/the shooter. You stick around and answer the questions.....

If you want to stay alive you might.

Does anyone know if spousal privilege comes into play here?

I'm willing to bet Dunn wasn't positive he killed someone.

However, knowing your husband fired shots off into a vehicle in the parking lot of gas station....I would call the police and report what happened.

That's just common sense and goes to establish your own innocents.

Instead they ran, which makes Dunn look all the guiltier.

I thought the woman was his "fiancee," that is not a "legal" term for either a civil union or a marriage.

Oh, I didn't realize. I haven't really been following this case. Like the Zimmerman situation I'm sure a bunch more stuff will come out in the future. Both men need fair trials. We aren't going to solve anything on the internet.
