    I think he knew exactly what he was doing but meant to deceive us. It was a tax all along, it'll cost 'em bad in November..

    Can someone please explain from their vast knowledge of the Constitution how he could have or should have foreseen the SCOTUS changing the legislation's "name" when that is outside their authority? It was not created as a tax and the ruling calling it a "tax" would not have been anticipated.

    In my limited understanding, that is.

    I'm sure you legal scholars can enlighten me as to why the constitutional scholar Obama would have guessed this. I'd particularly love to hear from those who participated in the thread where their legal knowledge made them certain that the SCOTUS would toss it out because you probably knew then that Roberts would call it a tax.

    Anyone care to enlighten the board why he would have expected this? Specifically?

    The only way it would pass is "as a tax". Anyone but Obama would have known this if they understood precedent. The administration did not argue it as a tax but eventually relented under judicial inquiry that it was a tax with a "whatever".

    It is apparent the Administration went in with arguments that it was not a tax but a penalty. Roberts exercised judicial activism by revising the Administrations argument. Even swing vote Kennedy did not buy it.

    Actually its not a tax increase you can avoid paying it by having health coverage, its more a tax penalty like paying your taxes late. That is like saying I will pay my taxes in July instead of April oh my they are taking more that is a tax increase.

    No...a better analogy would be to pass legislation forcing americans to drive cars that get 35MPG to "save the planet" and if you don't then you are "penalized" for not doing so. You know the only difference between the two? In my analogy you can simply choose not to own a vehicle and instead ride the bus, subway, walk, bicycle, helicopter, harrier jet, etc....Instead we are being "penalized" for simply being alive. There is a HUGE difference. So no...it is not like paying your taxes late. Not even close.

    And please stop arguing semantics...it is a freaking tax. Don't play coy.
