Depends upon the city and their laws. If I had killed my attacker with a glass bottle and he was the aggressor I would be fine.

The problem is not with the self-defense claim but the statements people make to the police without their attorney present that trips them up and makes them look shady.

I understand where Crickey is coming from and it is what the liberals want. They want to create a fear of defending oneself. They want you to be dependent on them.

Crickey yes many time there are inital charges but they are dropped. No some people who go out with a gun looking to be attacked may rot in a jail but mark my words: If you are where yo have business being (in your home or the mall or walking to a place you frequent legally) where you are when you are attacked then you will be fine.

 

I have never seen a self-defense case where the individual had his attorney present during questioning go bad. The problem comes with people who are hyped upon adrenalin making inconsistent claims during the questioning. I don't know why cops interview people right away when they are popping, but they do.

 

Exactly. When I was in high school me and another friend were jumped by 4 college kids (kids? 22 years old) on the street, much like these guys were doing. Looking for somebody smaller and less threatening to beat on. Another friend stopped in his car when he saw we were outnumbered and the situation changed drastically. Well two of them were put in the hospital, one ran off, and the last well let's just say he had to eat soup out of a straw for the next week or so. In any case when the cops got on the scene, "everybody" was going to jail. We tried to tell our side of the story and they really didn't want to hear it. When the supervisor got on the scene and found out we were all minors in high school and the damaged individuals were of age and in college the mood changed considerably. They took our names and info and sent us on our way.

Learned two very important things that night. When you are in a fight and it is over with, leave. And if you are questioned by a police officer, don't say anything but name, address, phone number, until you talk to a lawyer.

 

All one has to do is Watch enough of the First 48 and you'll know exactly how to handle yourself in a murder investigation. YOU **** and say GET ME A LAWYER.

 

Whatever happend to the good ol' days of just shooting the neighborhood cats with a pellet gun making them fall 25ft. from trees like squirrels?

The cops always seem so friendly, pretend to be on their side...that's how it goes south. People want to talk after being hurt.

I wish I had faith in Authorities crackdowns. People who feel threatened tend to give the more appropriate outcome, like in this OP. The authorities would have given them a slap on the wrist due to their age, and in doing so let others know the game is still on.
