    If you do not care about your 4th amendment rights, you also should not care about your 2nd amendment rights.

    Them clowns flat out must also comply with the constitution.
    It's time long overdue that all these bad apples can just stick around.
    There were even multiple cars who arrived on the scene. That's like 5 cops?
    And all of them did not know their own constitution!


    The insanity.

    So much of the US wanting to be nr1.

    I was hoping that the following channel on Youtube would come out with this. And he explains it far better than I apparently did in this thread. I agree 100% with this guy. I'd suggest everyone watch this and get a better understanding.



    I'd particularly like @Wild Bill Kelsoe and @notme to watch it.

    The police were called because of suspicious personS and the caller thought they had entered the home because she could not see them now. NOT because someone was watering flowers........he was not charged with burglary or even trespassing, THAT was cleared up by the neighbor, he was charged because he hindered their investigation and tried to walk away while they were lawfully detaining him for questioning.......can't you guys get anything right?

    Charges were dropped by the Judge because the police were being STUPID!!!!!!!

    The police screwed it up.

    It wasn’t a stranger to the property owner, but rather a stranger to an onlooker. If the onlooker is concerned and wants the police to find out if a crime is being committed that’s fine… but if no crime is being committed, then surely no arrest should be made.

    He wasn't handcuffed or arrested for not supposing to be there, he was handcuffed because he attempted to walk away from the officers while they were still talking to him and refusing to cooperate and that was before the police talked to any witnesses. He was arrested for his alleged obstruction into their investigation.

    No HE was STUPID and screwed up and they probably hope he learned his lesson.

    Meanwhile the JUDGE dropped the charges because the police were STUPID which you ignored over and over.

    He told them right from the start that he is Pastor Jennings and lives across the street which several NEIGHBORS soon backed him up including the woman who called 911 upon realizing who the person was told the police he is a neighbor there was ZERO signs that he was a danger to anyone and didn't have to pull out his wallet because the police didn't have legal cause to demand it.

    This is from the ARTICLE that I highlighted in red to show the police had ZERO reason to continue their stupid actions and take the handcuffs off:

    People who LIVES there told the police that he is a neighbor and was there legitimately that eliminated the polices justification to continue the arrest procedure.

    The JUDGE doesn't agree with you, maybe that should get your attention?

    The police should have dropped it since there was no serious crime being committed that justifies their demand for identification and that he was in a PRIVATE place.

    Now I have to wonder if Police anywhere thinks they should arrest people for the TERRIBLE crime of watering some plants while the occupants are out of town on a trip wow you fell for this hilarity.

    He wasn't attempting to leave the property, and your excuses are lame. There was no reasonable, articulable cause to detain him. But at least you aren't supporting the murder of Arbery again, so I guess that's a step up.

    That is not accurate, Alabama law has no such mandate. Individuals only have to show ID under certain circumstances, such as being pulled over while operating a vehicle. If there is reasonable suspicion of a crime, officers may request the individual's name and address, and explanation for their action.. which the individual in the video did do. He told them his name, and told them exactly where he lived and what he was doing

    The law does not require him to show his ID.. but besides that, he did not have an ID on him. If he did, the officers would have found it on him when they searched his pockets after handcuffing him

    For the umpteenth damn time. The cops were conducting an investigation, in reference to a call about a possible trespass. It wasn't a random stop. Jennings wasn't on HIS property. So yes, he was required to show his ID.

    No, he wasn't. Watch the video I provided. The guy in the video even provided the law and shows case law showing that he did not have to.

    Yes, there was cause to detain him. There wasn't cause to arrest him. Please watch the video provided in post 327. The guy in the video provides the laws in question and relevant case law.

    I appreciate the video and I'm big fan of the channel as well. However (and, admittedly, I haven't finished the video yet) listening to roughly 10:20-10:45 seems to indicate that the channel disagrees that there was reasonable, articulable suspicion to detain him.

    They got a call. Without much information at all. They had no reasonable, articulable suspicion that the guy watering flowers was committing a crime.

    What a dumbas$. Show your ID and have a nice day. I would hope that if the police were called for someone in my yard, they wouldn't just take the guys word for it that he was invited to be there. Why do people have to be so antagonistic?

    He was attempting to walk away from police who were conducting an investigation and questioning him in which he was a suspect under reasonable suspicion. He not only attempted to walk away, flee from the police, he challenged them to arrest him and detain him if they wanted to continue. The reason has be fully articulated and visible in the video. Your lame diversion ignored.

    And had no reasonable articulable suspicion that the guy watering flowers was just watering flowers until the police left so he could then break into the house.

    A call not only about him but about personS, more than one and that they may be in they house so the police had reasonable suspicion that there was another suspect lurking near by possibly still in the house and they had to be on the watch for that other person.

    According to that "logic," the police can just go around detaining anyone they want, without reason. Because, hey, they may be doing something innocent at the time, but who knows what they will do next! You are literally proposing a police state.

    You can't just detain someone because you got a phone call. That's not how the law works. This ain't rocket surgery. You need REASONABLE SUSPICION that THIS PERSON committed an ARTICULABLE CRIME. That didn't exist here.
