    You are forgetting that joining ISIS is to sever fealty to the USA, and become adversarial or a threat to the Constitution. I think they should be killed when found. ISIS is the devils own, and deserves absolutely nothing.

    Correct me if I am wrong, but didn't one of these national security acts, have provisions for doing exactly what was done to this person? I recall some people raising hell about it, when obama signed it. Most people didn't seem to care if such rights were taken away. Not because of fear of russia, but of radical islam. We will probably see more rights taken away with this russian fear mongering. Americans who remain quiet on losing more rights, must be some really big pansy, panty wearing, cowards? And not the transsexuals I am talking about. Ben Franklin pegged it. A very wise man.

    Clearly you don't understand the two replies or the constitution or the meaning of citizenship.. Maybe the U.S. and it's laws are really not suited to you, maybe Europe would be a better choice..

    I thought if you were in america, you were subject to our laws and rights? But really, I thought the guy was an american, and we can do the same to americans, which was...my...point. It was in one of the acts which has such a cute, oxymoronic name, like the Patriot Act. As if a patriot would agree with losing rights. lol

    when you declare your self an enemy combatant like this once American certainly did you aren't allotted due process under the constitution but instead you are under the Geneva Convention rules as a prisoner of war and you are handled by the DoD

    correct the military isn't bond by the constitution and much less so during a time of war
    It is why they have their own justice system called UCMJ which operates not restricted by the constitution

    Becoming an enemy combatant for another "nation" means that the Bill of Rights is suspended. This guy should go to Gitmo for enhanced interrogation and subsequent prosecution by a military tribunal.
