She certainly would have a case IMO. She isn't a public figure - she was a witness at a Congressional hearing. She wouldn't have any trouble proving he said it - it's all on tape. It wouldn't surprise me to know Gloria Allred has already been on the phone with her. This is the kind of case she likes.

 

SO you think limpblow, a drug addict, is not doing anything wrong when he attacks this woman?

That is one courts opinion about the first amendment, not what the actual content of the amendment. Again the amendments protect citizens, not churches. By extension the amendments protect churches because they are made up of citizens to be sure, but to suggest the catholic church has more rights then a non catholic employed by the church is asinine.

And I actually don't disagree with the ruling that employees employed directly for the purpose of worship/function of the religious aspects of a church can be exempt from certain employment laws... time and a 1/2 for a priest working on Christmas comes to mind.

 

Fluke made herself into a public fiqure by not only appearing but sharing her sex life with us. Just saw Fluke on Ed Schultz's show. Gloria like Sex, Drugs and Rock n' Roll cases.

She is not and was not a 'public figure' in any sense of the word.

 

I am the one arguing individual rights over a religions rights so why don't you explore your own flawed line of thinking before questioning the thought processes around those seeking the protecting a less demographically popular (in America) religions rights.

The last ruling was about employees of a church that directly serve in the religious functioning of said church, and I agree with that ruling. To suggest that ruling should also apply to St Jude hospital and the lapsed protestant that cleans bed pans on the 5th floor midnight shift is intellectually dishonest.

 

One does not have to be a lawyer to have read law and once a lawyer, one is more into making money in ones specialty than keeping up....I know a LOT about case law on a few areas of interest. Read the courts decisions and see what the real experts say...

 

She isn't the one who said she had sex 1000 times a year and was therefore a slut. It takes an extremely ignorant, uninformed person to construe the cost of BC for a year into the number of times a person has sex in a year.

Rush was probably going by the fact that he takes a Viagra pill (or 2 or 3) every time he has sex and figured BC pills work the same way. The man couldn't find his way out of a paper box that had a hole cut in the side.

 

The people who should be ashamed are the folk to lazy to do the research...
