    OHH, poor baby Fluke. I see old people all the time counting pennies in the pharmacy trying to pick up life saving RXs and this gal is complaining about birth control pills. Fluke is a disgrace. The Dems are defending the Fluke.

    Ah, so we get to the truth, that it is not a case of a woman's right to health but a case of religious freedom...once we are there we can discuss the real law and use real numbers excluding spoiled women who think they are owed free stuff.

    Put simply, does an actual constitutional protection trump a made up right.

    Conservatives say yes and Liberals say no...

    Once again...the law would force the insurance company, a religious organization, to eat the cost...there can be NO cost to the patient under the accommodation.

    I disagree that a right to not be discriminated against on the basis of religion is a made up right.

    SCOTUS has already ruled that Religoous institutions do not have to follow equal opproutinity law the sameway other do.....

    I don't and haven't made up my mind. There are definitely legitimate, competing interests.

    Does an employer have the right to discriminate on religious grounds in his employee decisions? IMO, not absolutely. Regardless of the employer's religious beliefs, should it have the right to not hire someone because of their religion beliefs? For example, should an employer have the right not to hire blacks if that would violate his religious beliefs? If not, then does it have the right to discriminate in the types of rules it has? In the types of benefits it supplies?

    I don't *think* it would be a particularly hard case.

    Impugning a woman's character is per se slander, or at least it is under the common law. Notwithstanding a qualified immunity a "news" broadcaster might have, his comments about a private person's sexual impropriety is probably per se slander, and in a lawsuit, I think Rush would have to prove the factual basis for the the truth of his statement and that he had a good faith basis for the statement. There would be the issue of damages, but where you had nationwide publication like this, you could come up with some hefty numbers.

    I imagine any number of lawyers might be willing to take such a case and wouldn't be surprised at all to see one filed.

    The institution does not get public funds even though the students who go there may get money for their education.

    The right IS one of discrimination, as in allowing religious organizations to NOT do things otherwise demanded....That is the case law on the issue.

    Laws that apply to others simply do not apply to religious organizations if the law attacks fundamental tenets of the faith.

    The Court rule only a month ago that discrimination laws do not apply to religious hiring...
