    Well said. Honestly, the clown would have a more valid reason...as he IS actually a professional clown, not just a guy who feels like one. But we both know, that wouldn't fly on a license...nor should it.

    Assuming he is transgendered or just a crossdresser either way more than likely when he is out in public he will be dressed as a girl. I don't see a problem since the ID will more closely resemble in on a daily basis. This is different than the Muslims that wanted to wear their hijabs covering their heads which obviously makes it harder to ID someone from that photo.

    There was a case were a Muslim women wanted to get an ID, but she wanted it to be taken in the “dress” they wear. If I remember right, she filed a lawsuit and lost. The court said that it was a picture ID and it had to show her face.

    they do not make everyone remove makeup, so he has a valid case.. all or none....

    But transgenders have existed for a long time. There was once a man who dressed in drag and it became popular to guess if it was a man or a woman. It got to the point where the French king told him to dress in his "whatever gender he was" clothes.

    he normally looks like the photo would of been, your saying he should intentionally change his appearance to look otherwise to get the ID, then go back to how he normally looks - that make no sense

    exactly, not to mention every women is allowed to wear make up, thus it's definitely gender discrimination

    can't claim it's a disguise while allowing half the nation to do it

    This is why if you loose a lawsuit you should pay for ALL legal expenses if you loose. This a stupid lawsuit by a stupid, confused idiot and we the tax payers are on the hook to pay to defend against total stupidity.

    You must be thinking of a different incident. This one involved a "he", not a she.

    This wasn't about clothing. A drivers license photo is only of ones face.

    Okay maybe "dress" was a little ambiguous. Let me be more clear, if anyone wants to wear makeup, they can, freedom of expression.

    Even if it changes their appearance to the degree that they are un-recognizable unless they are in their make believe personality?

    The question here seems to revolve around whether or not the kid can be said to be wearing a disguise. And I think there's an operational definition of a disguise, which surely references the normal, everyday appearance of the individual and the intent not to be recognized.

    From what I can see presented here, this qualifies as a disguise and should be disallowed.

    When I recently went to get my license renewed they wouldn't even let me wear my simple baseball cap, I had to remove it for the picture, does that give me the right to sue?

    All of these types of caveats specific to these special interests groups are why I just cant bother to support anything LGBT related.

    For every 1 truly legitimate item on their agenda there are 1,000 bogus ones, such as this.

    I listened to a local talk show on this very issue this morning. I can see both sides. If that is the way the person normally appears, then shouldn't the ID reflect that? Can a person wear a wig or dye their hair for the photo? I lost 40-50 pounds since my photo and look substantially different. Should I get a new one? If I grow a beard, should I be required to obtain a new ID? Or the opposite? Grow a beard for the photo and then shave immediately afterwards?
