Well, I don't think it's totally unprecedented to use an EO to do what would normally go through the constitution(He brings up DACA as an excellent example), Obama once declared it had to be legislative, he decides to do it via an EO and the SCOTUS at the time(a more liberal one to be sure) was like 'okay'.

I don't think it's far stretched for a more conservative court, who would see the EO as a correction, rather than an amendment itself to do what the then-Liberal court did in 2012.

Yeah, as an executive order, this would never fly. Congress would have to pass a law to amend 8 U.S. Code § 1401, but it's not a constitutional issue, as the hysterical leftists would have you believe. The drafters of the 14th Amendment were pretty clear on what they meant.

Technically speaking, no they don't. As an example, with ICE, we deport criminal aliens back to their nation of origin(be it Mexico or any of the Caribbean States.).
