Interesting legal question.

I'm leaning toward the Judge being technically correct and the part of Title 18 dealing with illegals obtaining weapons may be unconstitutional, but in this case, the person in question wasn't qualified to purchase a weapon because he lied on his background check, which specifically asks if he is a US citizen or legal immigrant. So he lied on the form or he would never have been sold the gun in the first place. So the end of this is that the guy was guilty of a felony and should be charged, tried, sentenced, and then deported after serving his sentence.

 

The ruling was that any non citizen can have a gun now. Which sets up now a bigger circle of members for towns to gather a militia for whatever law they want to put in place.
Title 18 of U.S. Criminal Code, which legally disallows undocumented individuals to possess firearms and ammunition "or to receive any firearm or ammunition which has been shipped or transported in interstate or foreign commerce."

The 14th amendment does say rights apply to any persons not just citizens.

I made the post to get the gun people's opinion of the ruling. I didn't realize a judge other than a Supreme Court judge had the authority to rule on the constitutionality of a law. Now I know.

I think the law is more in a non-citizen carrying around a gun is now legal. They don't necessarily have to have bought it. But if a city gives it to them to be as a police force then another group can't say anything about it.

Please understand that a judge doesn't base a ruling on weasel words, cynical vagueness, the kind that is in your comment, they base on the law and the constitutionality of a law.

So, if you can explain how the judges rulings was not in accordance with the constitution, then make that argument. But, weasel words of cynicism do not cut it.
