"Why Nurse Hickox Might Lose Legal Battle Against Ebola Quarantine"

    Nurse Hickox continues to defy even the voluntary quarantine of the state of Maine. She gave yet another ultimatum: if they don't remove this quarantine, she will go to court on Thursday. But would she win??? Whichever way it goes....I think she loses personally as most people, I believe, see her as a selfish person on this specific issue.



    "Writing for the Volokh Conspiracy, Eugene Kontorovich pointed out courts, including the Supreme Court, have deferred to the authority of state health officials in public health emergencies. Quarantines are rare and there are few relevant cases – Hickox’s lawyer acknowledged they “could be setting a precedent.”

    .....Kontorovich claims the few cases on the books don’t bode well for Hickox: “A brief review of the cases suggests it extremely difficult to challenge such an action without a clear showing of medical unreasonableness, or discriminatory application,” he wrote. “Indeed, I found no cases in which a quarantine has been lifted due process grounds (though there have been some successful challenges to conditions of quarantine).”

    In addition, he noted modern quarantine cases dealt with tuberculosis and smallpox, which are less lethal than Ebola. “All this shifts the presumption of validity even more towards the state,” he wrote, noting courts weigh the validity of the government’s interest against the individual’s right to liberty."

    I don't understand this woman... Why does she need to put other people at risk?
    What is wrong in staying in the quarantine? For Christ sake, it's the matter of national security, and the woman is being egoistic!

    If you are not contagious you do not need to be in quarantine. She is exaclty right. I suspect she is setting up an ass kicking law suit.

    Let us hope she loses, for the ability for us to force a quarantine upon people who might be carrying deadly diseases has to be in place in order to protect other people from the self centeredness and ego of one individual. This woman is a nutter, and one wonders why she went to Africa to begin with. For humanitarian reasons? Her actions here in America seem incoherent with that, and so she must have went because it was a very profitable move to go there, earning much more than she could here, taking care of sick americans. She was out for herself from the get-go and out for herself now.

    This is an American citizen who has shown no symptoms of any communicable disease.

    There is no reason for her to pander to paranoidal panic.

    The Centers for Disease Control and Prevention says that she can't spread Ebola if she isn't sick, doesn't have symptoms, and no one is in close contact with her bodily fluids.

    In matters of health, it's preferable to trust medical experts than allow politicians to dictate (although I'd love to see LePage, if he stands behind his witch-hunt hysteria, endanger his law enforcement authorities, court personnel, and incarceration guards by arresting an heroic Doctors Without Borders nurse.)

    So the Right is now adopting the standard that if someone or their actions constitutes a public health risk, they can have their freedoms restricted even though they may not have committed any crime.

    Where was this standard in the last fews years when applied to the health risks brought on by pollution?

    I've heard that watchng too much overhyped Ebola coverage on TV can make one more vulnerable to the virus; The virus knows when a person is scared much like a dog can sense fright and is more apt to bite.

    She is not contagious up until the moment she is.............then she is contagious in public..............

    there is no need for it to happen.

    I can assure you if it was you, you would want the doctors monitoring you, because the chance of survival is greatest when caught early.

    Why are thousands dying from it in Africa ? Are they licking each others hands ? Democrats and liberals love to defend defiance and put others at risk . Try using the same liberal logic about GUNS with ebola !

    This nurse is not contagious. She doesn't even have ebola.

    FYI you can't catch ebola from a person who isn't contagious.

    The CDC had it right at the beginning, but then the media led the masses into a hysterical state and they had to change course, not to deal with ebola, but to deal with a public that had become hysterical from ignorance.

    If nothing else, the hysteria from this is demonstrating why new agencies should be banned from funding themselves through paid advertising.
