Could being Gay be a Religion?

    This would never fly in court (which is why it never has yet). An attorney would be laughed at for bring it up. Just cite me an example of this working ANYWHERE. It is starting to become laughable.

    Um...fighting for religious freedom has never been done or successful? I don't buy that.

    Well to do that they must repeal the first amendment and become a theocracy.

    You can make any claim you want. As far as having a recourse with your employer, you wouldn't any more than a Hasidic Jew that gets fired from a nightclub for leaving before dark.

    How can you not get this. Jews are a protected class. I can not fire an employee who does a great job in every way for the SOLE reason of being a jew. I can fire a person who does a great job in every way for the SOLE reason that he loves football and claims it is his religion. You find me a case where a person has claimed religious protection that is not in a state recognized religion and I will admit you are right. But you are flat out wrong. Sorry.\

    Unfortunately you can be fired in some states simply for being gay. And declaring that gay is your religion offers you no protection. Cite the case or admit you got this one wrong.

    Sabbath is from Friday, sundown to Saturday sundown, and post Sabbath prayers.
    Not just sundown.
    Not likely a Chassid is working in a nightclub.

    Some States beat all protection by being "at will employers" you sign an agreement and can be legally terminated without a specified reason.

    Well that's exactly what you're doing. You are saying the government needs to decide which religion is legitimate and which one is fake in complete defiance of the first amendment.

    It's just because you don't like the idea of religion being used this way. You talk about it being repugnant and insulting.

    Um...every citizen is protected by the constitution.

    So the protected class is citizen and every citizen is part of it

    Nowhere in the first amendment does it say that government must define religion to be legitimate for you to have the right to it. Further it states expressly that the government is forbidden to do so.

    So everybody is in the protected class.

    This nation isn't a theocracy the government cannot define a religion as legitimate.

    And people do. We had an ass clown in Oregon claiming that baking a cake was part of their religion.

    People do it all the time.

    Duh..protection. just a wild guess that the reason for protection is to protect something.

    This is hilarious. If every citizen is in a protected class WHAT IS THE POINT OF LISTING PARTICULAR GROUPS IN A PROTECTED CLASS? You have zero understanding of constitutional law in this matter. I can fire you for being a football fan, for being a skier, a golfer a rodeo clown BECAUSE THOSE ARE NOT PROTECTED CLASSES.

    If the government can not recognize a religion why can they do it for tax reasons? Doesn't this violate the first amendment?

    Come on man.....this is getting ridiculous.

    You can't fire a person for being a sports fan, you can fire someone for lateness, or absenteeism, you keep making stuff up.

    I can form a 501-3C as long as it meets the requirements in my State, and anything can be a basis as is Islam for example.
    Muhammad stated, I studied with Jews and Christians etc...... did not find them acceptable, he took the odd bits he liked and founded Islam.

    No different than Football if I decide to found a religion based on that game as did the Aztecs.

    Druids worship trees, it is a religion as well as worshiping stars in the sky.

    Absolutely and completely untrue. In a right to work state I can fire you because of ANY reason that is not covered by a protected class. You are right in that you can form any religion you like....you could replace Jesus with Joe Namath and call it Broadway Joe religion. Now you have to get the government to accept it. It took scientology 25 years. Good luck.

    Btw I'm Christian so I think that is a legitimate religion.

    Well, the nation haven't repealed the first amendment. So I can't cite a case of something not happening. That would be asking me to prove a negative.

    So cite where they repealed the first amendment or you are wrong whether you admit out or not.

    Holy cow. I am not claiming what I want. I an stating what is current law in the US. If you can prove ANY of the claims you are making I would love to see the evidence. I showed evidence of a group (scientology) that fought for 25 years to be recognized as a religion by the government. You have zero evidence. What you claim has NEVER happened in this country. Not once. Not a single time. Just cite one case where it has. you can't. Sorry man...you lost this one

    The protections in the constitution apply to every citizen, not particular citizens. We don't have titles of nobility or waif class in the United states.

    So I don't know where to begin with that nonsense.

    Just so you know (if you were conservative you'd know this.) The constitution protects all citizens from the government.

    Umm.... I never argued the first amendment protects your hobby.

    So you keep saying this cheap like it matters.

    I could fire somebody for not coming to work on Sunday even if it is a religious obligation.

    I cannot fire somebody however because I disagree with the way they interpret a religion. That's against the law.

    They actually don't recognize a religion, they exempt an organization.

    You do not understand the process.

    A Religion is founded, and applies for 501-3C status, this has zero to do with doctrine or sacraments etc,, it has to do with meeting the set criteria.

    Well, Yeah, but I never argued that you can't fire somebody because they like a hobby.

    So you may be mentioning stuff that is legal but it is no argument against my position.

    My position is that the first amendment protects the free exercise of religion.

    Here is what it says:
    Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.

    That amendment says that the government can't restrict my right to free exercise of my religion.

    The spouse I chose has a lot to do with my religion.





    And that is an atheist cult. And a scam. Clearly the government can't say what is a legitimate religion can they?
    Well they haven't repealed the first amendment. The lack of evidence of the repeal of the first amendment is beneficial to my position.
    Actually it has. Hobby lobby fought for the right to free exercise of religion and won. And that's the most recent case. In sure I could find a few.
    Foot in your mouth kiddo. I cited the hobby lobby case.

    They felt it was against their religion to pay for abortions and actually win their case.

    So sorry, I cited a case, I could and I did.

    So please explain where I was wrong?

    You have gone off the rails. Hobby Lobby has nothing to do with what you are talking about. Why will no lawyer take a case claiming being gay is a religion. People are fired for being gay all the time. Do you think you are the first to think of this? It has been thought of before.....and laughed at because it is ridiculous. This is why you can not cite a single case.

    Easy, they don't audit them or collect taxes.

    They don't qualify as tax exempt.


    The first amendment still hasn't been repealed regardless of tax code.
