The police, FBI, CIA, SS, USBP, and just about any other federally contracted mercenary organization (Blackwater for example) doing the bidding of the local/state/federal government are not the military.
In a state of emergency, what would be to stop them? Technically he is correct, what is under question is can they do it on a whim without the appropriate authority. Can you imaging what kind of extreme circumstances would have to arise for a sitting President to actually do something like that? I would say people who hide under their bed during a lightning storm have a more valid concern than anyone who is afraid of this.

Yes, but when I shake mine, I'm relaxed and worry free.
